On the morning of February 15, continuing the 9th extraordinary session of the 15th National Assembly, the National Assembly discussed in the hall the Law on Organization of Local Government (amended).
In the draft law submitted to the National Assembly, the Government withdrew the proposal to abolish People's Councils in districts, wards and communes in urban areas (including communes under districts, towns, provincial cities, and cities under centrally run cities). Accordingly, at all administrative units at all levels, the local government organization includes People's Councils and People's Committees, except in specific cases prescribed by the National Assembly.

Expressing his opinion, delegate Ha Sy Dong, acting Chairman of the People's Committee of Quang Tri province, suggested the need to strongly innovate the organization of local government, especially in urban areas, to promote development.
He analyzed that the draft regulations maintain the current local government organization model, without any innovation, "going against the current trend of streamlining the apparatus".
According to the delegate, the Party's policy through many congresses has directed the need to innovate the organization and operation of local governments in accordance with urban, rural and island characteristics.
Practice also shows that after amending the Law on Organization of Local Government in 2019, Da Nang City, Ho Chi Minh City, and recently Hai Phong City were allowed by the National Assembly to implement one-level urban government and it has shown to be very effective.
From that, delegate Ha Sy Dong said that in the current conditions, we are implementing a revolution to streamline the organizational apparatus, so the local government organization also needs to be redesigned to suit the characteristics of urban areas and rural areas.
"This is not against the Constitution," Mr. Dong said and suggested that while the organization of local government in rural areas has not been innovated, it is necessary to strongly innovate the organization of local government in urban areas to promote development.
Sharing the same view, delegate Tran Quoc Tuan, Head of the Propaganda and Mass Mobilization Department of Tra Vinh Provincial Party Committee, also proposed to innovate the organization of local government in urban areas like Da Nang City, Ho Chi Minh City and Hai Phong City which are being effectively piloted.
"This will be the basis for effectively implementing the current apparatus streamlining revolution, creating a driving force to promote national development," said Mr. Tuan.

Overall organizational structure is being evaluated, there will be adjustments and arrangements.
On the contrary, delegate Pham Van Hoa (Dong Thap delegation) agreed with maintaining the current local government organization model, including the People's Council and the People's Committee. He emphasized that it is impossible not to have People's Councils at the commune level. However, the delegate also said that the urban government model has been piloted in some central cities, so he suggested that it be studied for general implementation nationwide.
"It cannot be done only for centrally-run cities, while provincial cities are also urban areas," said Mr. Hoa.
Explaining at the end of the discussion, Minister of Home Affairs Pham Thi Thanh Tra said that the Government proposed to keep the current structure because it is streamlining and streamlining the apparatus. At the same time, it will continue to evaluate the overall organizational model of the entire political system and will make adjustments and arrangements.
"Otherwise, there will be shortcomings in the operation and organization model of local government," Minister Tra emphasized.
Ms. Tra also said that localities that are piloting or organizing special local government models according to the National Assembly's resolution will follow the resolutions. Other central cities can propose to pilot or organize special models to remove the People's Council, "without any problems".
"In the context of our restructuring of the apparatus, the Ministry of Home Affairs is coordinating with the Central Organizing Committee to conduct a comprehensive assessment and study of the apparatus organization model, and would like to ask for delegates' support for the current temporary stability plan," said Ms. Tra.
Previously, in the draft law submission, the Minister of Home Affairs said that the withdrawal of the proposal to abolish the People's Council was in accordance with the direction of the Politburo and the conclusion of the National Assembly Standing Committee.
