Abolish proposal to exempt from taking confidence vote for cadres treating serious illnesses

The National Assembly passed a resolution on voting and a vote of confidence, which does not stipulate exemption from voting for officials with serious illnesses or who have been off work for 6 months or more.

The resolution on taking a vote of confidence and a vote of no confidence for people holding positions elected or approved by the National Assembly or People's Council, passed by the National Assembly on the afternoon of June 23, stipulates three cases where a vote of no confidence is not taken. These are officials who have announced their resignation, are waiting for retirement, or have been appointed or elected in the year of the vote of no confidence.

In the report on acceptance and explanation, Chairman of the Law Committee Hoang Thanh Tung said that some delegates suggested that it is necessary to closely follow the Central Regulation No. 96. The National Assembly Standing Committee found that the vote of confidence is an important monitoring channel of the National Assembly and the People's Council. The results of the vote of confidence are used to evaluate cadres, serving as a basis for planning, mobilizing, appointing, recommending cadres for election, dismissing and implementing regimes and policies for cadres.

Regulation No. 96 has specifically defined cases where a vote of confidence is not conducted. Therefore, taking into account the opinions of delegates, the National Assembly Standing Committee has revised the regulation in Clause 5, Article 2 of the Resolution as above.

Some opinions proposed to fully supplement the positions elected or approved by the National Assembly and People's Councils to the list of positions eligible for a vote of confidence, such as members of the National Defense and Security Council, Supreme People's Court Judges, Deputy Heads of the People's Council Committees, and Jurors of provincial and district People's Courts.

However, according to the National Assembly Standing Committee, the total number of people holding positions and titles elected or approved by the National Assembly and People's Councils is quite large. To ensure practical effectiveness, the Resolution only stipulates taking a vote of confidence for people holding positions that have important influence on the promulgation and implementation of policies or people holding positions at agencies with a role in leading and directing regular activities.

The vote of confidence will not be applied uniformly to all positions and titles elected and approved by the National Assembly and People's Councils, such as Judges, People's Assessors or deputies at the People's Council's Committees.

According to the Resolution, the National Assembly will take a vote of confidence for the President, Vice President; Chairman of the National Assembly, Vice Chairmen of the National Assembly, members of the National Assembly Standing Committee, Chairman of the Council of Nationalities, Chairmen of the National Assembly Committees, Secretary General of the National Assembly; Prime Minister, Deputy Prime Ministers, Ministers, other members of the Government; Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy and State Auditor General.

The People's Council shall take a vote of confidence for the Chairman and Vice Chairman of the People's Council, Head of the People's Council's Committee; Chairman, Vice Chairman of the People's Committee and members of the People's Committee. In case a person simultaneously holds multiple positions subject to a vote of confidence, the vote of confidence shall be taken once for all positions.

The vote of confidence is conducted by secret ballot. The ballot clearly states the full names and positions of those who are voted on with the levels of "high confidence", "confidence", and "low confidence". Officials who are rated "low confidence" by more than half to less than two-thirds of the total number of delegates must resign within 10 days from the date of announcement of the results of the vote of confidence.

It is expected that the 15th National Assembly will take a vote of confidence for those holding positions elected or approved by the National Assembly at its sixth session, opening in October 2023.
