On March 26, the Ministry of Public Security posted a draft Circular amending and supplementing a number of articles of Circular No. 67/2019 regulating the implementation of democracy in ensuring traffic order and safety (referred to as Circular 67) to solicit comments from agencies, organizations and individuals.
According to current regulations in Circular No. 67, the police force must publicize 6 groups of contents when performing the work of ensuring traffic order and safety.
One of the above is "the plan for general control of means of transport, the plan for patrolling, controlling and handling violations by traffic topic, the plan for regular patrolling, controlling and handling violations, including the following specific contents: name of unit; route; types of vehicles and violations to be controlled and handled; implementation time".
In the draft amendment, the Ministry of Public Security proposed that the traffic police force only publicize the plan for general control of vehicles. The publicized contents include: Name of the unit; Route; Types of vehicles and violations to be controlled and handled; Implementation time.
Compared with current regulations, the public content on "patrol, control, and violation handling plans by traffic topic, regular patrol, control, and violation handling plans" has been abolished.
The Ministry of Public Security affirmed that the above changes are very necessary; ensuring legality and consistency with the current system of legal documents; at the same time ensuring feasibility, stability and closeness to the practical work of ensuring traffic order and safety, consistent with current legal documents on implementing grassroots democracy.
"After more than 4 years of implementation, Circular No. 67 is no longer suitable for the actual situation, causing many shortcomings. The supervision of some people over the traffic police force is sometimes not objective and in accordance with regulations, taking advantage of the right to supervise to film, record, and take photos of the working process with traffic police officers and soldiers and sharing them on social networks," the Ministry of Public Security commented.
According to the Ministry of Public Security, this situation has led to a fear of collision and a lack of responsibility among some officers and soldiers directly performing their duties, affecting the image of the traffic police force. At the same time, some opposing elements have taken advantage of this situation to incite people to send complaints and denunciations to many places, causing complications for law enforcement on traffic order and safety.
"The public announcement of patrol, control and administrative violation handling plans is being exploited by some individuals to cause difficulties for traffic police in their patrol and control work on the roads," said the Ministry of Public Security.
The collection of comments from agencies, organizations and individuals will take place within 60 days from the date of posting.
