Mr. Luong Qui Phuc, Director of Phu Duc Construction Materials Production Company Limited (abbreviated as Phu Duc Company, headquartered in Linh Trung Ward, Thu Duc City) filed a petition for help, denouncing the leaders of the People's Committee of Linh Trung Ward (Thu Duc City, Ho Chi Minh City) for covering up, allowing Mr. D.TQ to blatantly continue to illegally build a model villa at an address without a number, alley 306, Linh Trung Street, Quarter 1, Linh Trung Ward.

The model villa was forcibly demolished but construction continued brazenly.

Mr. Phuc stated that in 2012, his family got to know and let Mr. D.TQ stay in a model villa at an address without a number, alley 306, Linh Trung street, quarter 1, Linh Trung ward, part of a housing project in Linh Trung ward, Thu Duc city.

In order to continue implementing the project after many years of financial difficulties and the Covid-19 pandemic, as well as completing legal procedures as required by the authorities, Mr. Phuc's family asked Mr. D.TQ to hand over the model villa for the company to demolish because the model house was built illegally.

In May 2020, Phu Duc Company proceeded to dismantle the model house above, but Mr. D.TQ's people appeared and prevented it, with the reason that the above house was given to Mr. Q. by Mr. Phuc's father, after Mr. Q. provided legal advice to Mr. Phuc's father in a criminal case.

Because Phu Duc Company did not dismantle the illegal constructions, in 2020 and 2021, the Chairman of Thu Duc City People's Committee issued decisions to enforce the illegal constructions. After that, Mr. D.TQ sued the decisions of the Chairman of Thu Duc City People's Committee in court.

Mr. Phuc said that while the case had not been resolved and the illegal construction had not been forcibly demolished, Mr. D.TQ continued to brazenly rebuild the model villa that had been partially demolished by the company. Therefore, he was upset and sent a complaint to the leaders of Linh Trung Ward People's Committee for covering up and allowing the illegal construction to continue.

"The villa was partially demolished, then continued to be illegally and permanently built from month to month. It cannot be said that the ward is not responsible," Mr. Phuc was indignant.

Ward People's Committee Chairman: "Will organize enforcement in June"

Talking to Thanh Nien reporter, Chairman of Linh Trung Ward People's Committee Tran Quoc Hung informed that at the project location of Phu Duc Company, Linh Trung Ward People's Committee has drawn up a record to handle administrative violations in the field of construction at the model villa project against Phu Duc Company (1 decision), and Mr. D.QT (2 decisions).

Regarding the illegal construction project invested by Mr. D.TQ, after Phu Duc Company demolished it, Mr. Q. continued to build, so the ward continued to issue a decision on enforcement.

“Mr. Q.’s illegal construction is currently in civil dispute, administrative decision appeal, and has not yet been resolved by the court. Enforcement may cause legal consequences that are difficult to overcome.

Therefore, the Ward People's Committee is waiting for the completion of the procedures for handling Mr. Q's violating construction to organize a one-time implementation of the decisions on handling administrative violations," said Mr. Tran Quoc Hung.

According to Mr. Tran Quoc Hung, the Ward People's Committee is coordinating with the Thu Duc City Urban Order Management Team to advise the Ho Chi Minh City People's Committee to issue a decision to enforce the demolition of Mr. D.TQ's second illegal villa (which has structural connections with the illegal construction of Phu Duc Company and Mr. D.TQ's first illegal construction). The expected time for enforcement is from June 12 to 16.

Speaking with Thanh Nien reporter, Mr. D.TQ said that he himself "only repaired, renovated and upgraded the villa according to the law".

Furthermore, according to Mr. Q., he does not agree with the government's decisions on penalties and enforcement, so he has filed a lawsuit and is waiting for the court to resolve the matter.
