On January 24, Mr. Tran Minh Khoa, Chairman of the People's Committee of Phu Quoc City, Kien Giang Province, said that he had signed decisions to impose administrative penalties on Mr. Le Trong Dai and Tran Van Luong for many violations in the fields of land and construction.
The illegal construction site is promoted as a tourist area as a masterpiece of Phu Quoc Pearl Island.
Specifically, Mr. Le Trong Dai (born in 1982, permanent resident of Ho Chi Minh City) is the owner of a 3-hectare land plot on top of Dien Tien hill, Duong Dong ward, Phu Quoc city.
Mr. Dai leased land to Mr. Tran Van Luong (residing in Ho Chi Minh City) to illegally build a tourist site on agricultural land without project approval or licensing.
Accordingly, Mr. Dai was fined for three violations: Organizing construction of a project that is not in accordance with approved construction and urban planning with an area of 69.7 square meters; Encroaching on land with an area of 257.1 square meters managed by the Ward People's Committee; Encroaching on protective forest land with an area of 501.2 square meters.
Phu Quoc authorities forced violators to restore the land to its original state before the violation.
The total fine for Mr. Dai's three violations is 120 million VND; he must return the illegal profits gained from the violations, amounting to nearly 30 million VND.
In addition, Mr. Dai was also forced to restore the original condition of the land before the violation for areas of 257.1m² and 501.2m²; forced to demolish the illegal construction part for an area of 69.7m². The time limit for implementing remedial measures is 30 days.
Decision to sanction violations against three violations of Mr. Le Trong Dai.
Mr. Tran Van Luong (born in 1974; permanent resident of Ho Chi Minh City) is the person who rented the land from Mr. Le Trong Dai to illegally build The Peak tourist area on Dien Tien mountain.
Mr. Luong was fined for four violations: Converting perennial land with an area of 5,146.2m² to land for production and business without permission from the competent authority; Deforming the terrain of the land with an area of 2,622.5m²; Organizing construction of works not in accordance with approved construction planning and urban planning with an area of 69.7m²; Encroaching on land with an area of 257.1m² managed by the Ward People's Committee.
The total fine for Mr. Luong's four violations above is 175 million VND.
In addition, Mr. Luong must also pay back 200 million VND, the illegal profit gained from committing the violation.
Decision on administrative sanctions against Mr. Tran Van Luong.
The decision also requires Mr. Tran Van Luong to restore the original condition of the land before the violation for the land area of 5,146.2m²; 2,622.5m²; 257.1m² and demolish the illegal construction part for the area of 69.7m². The time limit for implementing remedial measures is 30 days.
According to the results of the inspection of violations by the authorities, the land with many violations mentioned above is about 3 hectares wide, including 42 adjacent plots of land with Mr. Le Trong Dai as the owner, and has been granted a land use right certificate. Of which, 300 square meters is urban land, the rest is land for perennial crops.
In early 2024, Mr. Dai built a house in an area that had not yet changed its land use purpose to residential land, so he was fined by the People's Committee of Phu Quoc City and forced to dismantle the illegal construction.
After dismantling the illegal construction, Mr. Dai contracted to lease the land back to Mr. Luong to continue building The Peak tourist area without permission from the authorities.
It is worth mentioning that, even after the People's Committee of Duong Dong Ward made a record of administrative violations due to illegal construction, the next day and the following days, many workers and machines continued to construct.
By the New Year 2025, this illegal construction site officially opened to welcome visitors with an entrance fee of 150,000 VND/person.
On the Facebook page of this tourist area, they confidently asserted that they were allowed to operate, posting many reviews with compliments that this is a masterpiece of the Pearl Island.
