(Chinhphu.vn) - On the morning of April 16, Deputy Prime Minister Tran Hong Ha chaired a meeting with the Ministry of Natural Resources and Environment and a number of relevant ministries and branches on the progress of drafting documents detailing the implementation of the 2024 Land Law.

Attending the meeting were Minister of Natural Resources and Environment Dang Quoc Khanh, Minister of Agriculture and Rural Development Le Minh Hoan and leaders and representatives of a number of ministries and branches.
The Deputy Prime Minister emphasized that the Prime Minister has issued a document directing ministries and branches to urgently develop detailed guidance documents, ensuring sufficient conditions for the National Assembly to consider and allow the 2024 Land Law to take effect on July 1, 2024 (5 months earlier than the law stipulates on January 1, 2025). This requires great efforts and determination from ministries and branches, but must fully implement the steps of the legal document drafting process.
"Developing legal documents is one of the highest priorities of the Government and the Prime Minister. This is the responsibility of Government leaders, ministers, and heads of sectors," the Deputy Prime Minister stated.
Deputy Minister of Natural Resources and Environment Le Minh Ngan said that the Ministry of Natural Resources and Environment has presided over the drafting of 6 decrees and 4 circulars. In particular, the draft Decree detailing the implementation of a number of articles of the Land Law consists of 10 chapters and 115 articles detailing 51 contents assigned in the Law, focusing on general provisions; functions, tasks, structure, and organizational apparatus of land registration organizations, land fund development organizations; land use planning and plans; land recovery, land requisition; land fund development, management, and exploitation; land allocation, lease, and change of land use purposes; land use regime; monitoring and evaluation of land management and use; specialized land inspection; settlement of land disputes, and handling of violations of land laws by those who violate land laws when performing official duties in the land sector.
The Ministry of Natural Resources and Environment has established a Drafting Committee and an Editorial Team to provide comments on the Decree, and at the same time collect comments from relevant departments and branches in 63 provinces and cities; receive comments, edit documents and submit to the Ministry of Justice the Decree regulating compensation, support and resettlement when the State recovers land; the Decree regulating basic land survey, registration, granting of certificates of land use rights, ownership of assets attached to land and land information system; the Decree regulating land prices; the Decree regulating administrative sanctions for violations in the land sector; the Decree regulating sea encroachment activities.

The Deputy Prime Minister assessed that the Ministry of Natural Resources and Environment has proactively and promptly implemented the Government's direction, and needs to continue to clarify issues with different opinions on scope, subjects, implementation policies, etc.; urgently seek opinions from localities, enterprises, organizations, socio-political organizations, etc. on regulations on compensation, support, resettlement, land valuation, "whether it is feasible, whether it is possible to reform administrative procedures, decentralize and delegate power further, whether the level of digital transformation has been achieved or not"; develop and promulgate according to simplified procedures the Decree regulating sanctions for administrative violations in the land sector, etc.
After listening to Deputy Minister of Finance Bui Van Khang report on the progress of drafting two decrees regulating land use fees, land rents; organization and operation of the Land Development Fund, Deputy Prime Minister Tran Hong Ha noted that there should be policies and financial tools to handle land areas that have not been or are slow to be put into use, farm and forestry land, and to combat land speculation...
Meanwhile, Minister of Agriculture and Rural Development Le Minh Hoan said that there are many new contents and issues arising in the process of amending and supplementing Decree 156/2018/ND-CP detailing the implementation of a number of articles of the Forestry Law, as well as developing a decree detailing rice-growing land. The Ministry of Agriculture and Rural Development is collecting opinions on the draft of these two decrees according to regulations.
The Deputy Prime Minister requested the Ministry of Agriculture and Rural Development to make efforts to ensure the timely submission of the draft decree detailing regulations on rice-growing land, thoroughly implementing the spirit of decentralization, delegation of power, and reforming administrative procedures, and providing conditions and criteria for monitoring, inspecting, and evaluating the implementation of regulations on forestry land and rice-growing land.

The Deputy Prime Minister emphasized that the process of developing documents guiding the implementation of the 2024 Land Law must thoroughly grasp the spirit of "early, from afar", thoroughly resolving issues with different opinions and thinking, in order to ensure consistency and uniformity before submitting them to competent authorities for consideration and comment. In particular, the legal documents that each ministry and sector is responsible for developing must demonstrate an organic relationship, implement the consistent goals set out in the 2024 Land Law and be consistent and consistent with other relevant laws; at the same time, be comprehensive, inherit the values and correct regulations that have been affirmed in practice; thoroughly decentralize and delegate power; promote digitalization and implement administrative procedures on land in the electronic environment.
The Deputy Prime Minister requested the Ministry of Justice and the Ministry of Natural Resources and Environment to coordinate and urgently prepare documents and procedures to submit to the National Assembly to issue a Resolution allowing the 2024 Land Law to take effect on July 1, 2024.
The Ministry of Construction urgently develops documents detailing the 2023 Housing Law and the 2023 Real Estate Business Law to promptly take effect in sync with the 2024 Land Law on July 1, 2024.
