(PLVN) - Deputy Prime Minister Tran Hong Ha has just signed Decision No. 575/QD-TTg dated March 12, 2025 promulgating the Plan to implement the Law on Geology and Minerals No. 54/2024/QH15.
Law on Geology and Minerals No. 54/2024/QH15 was passed by the 15th National Assembly, 8th Session on November 29, 2024, effective from July 1, 2025 (Point d, Clause 1, Article 6, Article 72, Article 73, Article 74, Clause 1, Article 109 and Point b, Clause 2, Article 111 of the Law on Geology and Minerals effective from January 15, 2025).
In order to implement the Law on Geology and Minerals promptly, synchronously, uniformly and effectively, the Prime Minister issued a Plan to implement the Law on Geology and Minerals with the aim of raising awareness of the Law on Geology and Minerals and the responsibilities of all levels, sectors, people and centrally-run provinces and cities in implementing the Law on Geology and Minerals; specifically defining the work contents, deadlines, completion progress and responsibilities of relevant agencies and organizations in organizing the implementation of the Law on Geology and Minerals, ensuring timeliness, synchronization, uniformity, effectiveness and efficiency.
Accordingly, it ensures the unified direction of the Government and the Prime Minister; close, regular and effective coordination between ministries, ministerial-level agencies, government agencies, localities and relevant agencies and organizations in implementing the Law on Geology and Minerals. At the same time, it determines a specific implementation roadmap to ensure that from July 1, 2025 (Point d, Clause 1, Article 6, Article 72, Article 73, Article 74, Clause 1, Article 109 and Point b, Clause 2, Article 111 of the Law on Geology and Minerals effective from January 15, 2025) the Law on Geology and Minerals and documents guiding the implementation of the Law are implemented uniformly and synchronously nationwide.
The Ministry of Agriculture and Environment shall preside over the development, compilation of documents to disseminate, propagate and provide in-depth training on the contents of the Law on Geology and Minerals for relevant agencies and organizations to study and learn; organize conferences to disseminate and provide in-depth training on the Law on Geology and Minerals, and legal documents detailing the Law on Geology and Minerals for central agencies and People's Committees of provinces and centrally-run cities. Implementation period is in 2025 and the following years.
Organize propaganda and dissemination of the contents of the Law on Geology and Minerals and new points of this Law in diverse forms, suitable to actual conditions and situations; organize the implementation of columns, programs, news and articles disseminating the Law on Geology and Minerals, legal documents detailing this Law on mass media or other forms according to the provisions of law on dissemination and legal education.
The Ministry of Agriculture and Environment shall preside over and coordinate with ministries and branches to systematize and list legal documents related to the field of geology and minerals; review them for promulgation under its authority or submit them to competent state agencies for amendment, supplementation, replacement, repeal or new promulgation, ensuring compliance with the provisions of the Law on Geology and Minerals.
Regarding the development and promulgation of legal documents detailing and guiding the implementation of the Law on Geology and Minerals, implemented in accordance with Decision No. 1610/QD-TTg dated December 19, 2024 of the Prime Minister on promulgating the List and assigning the agency in charge of drafting documents detailing the implementation of laws and resolutions passed by the 15th National Assembly at the 8th Session.
Within the scope of its tasks and powers, the Ministry is responsible for: Synthesizing the results of basic geological surveys, geological surveys of minerals; exploiting and using geological resources; mineral activities; managing information and data on geology and minerals; delimiting and announcing areas with small, scattered minerals; delimiting and submitting to the Prime Minister for approval national mineral reserve areas and lists of strategic and important minerals.
Ministries and branches are responsible for performing state management within the scope of their tasks and powers and coordinating with the Ministry of Agriculture and Environment to perform state management tasks on geology and minerals according to the provisions of the Law on Geology and Minerals and other relevant current legal provisions.
The provincial People's Committee, within the scope of its tasks and powers, is responsible for: Issuing regulations on coordination between localities or between localities and ministries and branches in state management of minerals; organizing and directing the implementation of specialized inspections and examinations of geology and minerals in the area; resolving complaints and denunciations about geology and minerals and handling violations of laws on geology and minerals in accordance with the provisions of law; organizing the control and supervision of all mineral activities and mineral recovery in the area...
The Ministry of Agriculture and Environment shall preside over the organization of monitoring, inspection and reporting on the implementation of the Law on Geology and Minerals. The implementation period shall be every two years and upon request.
