Under the ban just signed by Montana Governor Greg Gianforte, TikTok will not be allowed to operate within the state of Montana, which has a population of just over 1 million people.
As a result, Montana will become the first state in the US to block downloads of the world's most popular short-video app starting January 1, 2024. The platform will be fined $10,000 for each violation if users in Montana can access/are provided with access or download TikTok, and can be fined an additional $10,000 per day if they do not comply.
Additionally, the Google Play Store and App Store that offer TikTok within the state of Montana are also illegal. Apple and Google will have to remove TikTok from their app stores or face a daily fine of $10,000 per violation. However, these fines will not apply to individuals using TikTok.
In response to the move, a TikTok spokesperson said the ban “violates Montanans’ First Amendment rights by unlawfully banning TikTok,” and affirmed that TikTok “will protect the rights of its users inside and outside Montana.”
Earlier, in late December 2022, Governor Greg Gianforte banned the use of the TikTok application on all state government devices, citing the “significant risk” to sensitive state data. More than half of the US states and the federal government have now issued similar bans to Montana.
According to the Pew Research Center, 67% of American teenagers between the ages of 13 and 17 use TikTok, and 16% of American teenagers say they use the app regularly. Meanwhile, TikTok says the majority of its users are over 18.
