36 months to complete 1,300 billion VND apartment renovation project in Hue

In addition to the reason for not agreeing on a compensation plan, what most of the remaining households are worried about is the temporary housing arrangement time, not knowing how long it will take to be provided with housing.

“The project investor needs to clearly state the time and date of receiving the house after the project is completed so that people can feel secure in handing over the land. Because we are worried that after handing over the apartment building, the investor will delay the construction or may sell the project to another unit, then we don’t know when people will have a house to live in,” said Ms. Bui Thi Nhuan, living in apartment P.209, block A, Dong Da apartment building - one of the remaining households.

Regarding this issue that people are worried about, Vice Chairman of Thua Thien-Hue Provincial People's Committee Hoang Hai Minh has sent a written response to each citizen.

According to the response document, regarding the project progress, in Decision No. 2088/QD-UBND dated September 8, 2023 of the Provincial People's Committee on accepting the investment policy at the same time as accepting the investor to renovate and rebuild blocks A, B, C of Dong Da apartment complex, the project implementation progress is 36 months from the date of handover of the site.

The above time does not include cases of force majeure or objective reasons and is implemented according to legal regulations.

Not only that, to speed up the project progress according to the people's request, the investor also sent Document No. 43/VBCK-DD dated August 1, 2024 to the Provincial People's Committee and the Steering Committee, in which it committed to the project progress: "The investor commits to the project progress not exceeding 36 months (including force majeure cases), from the date the competent authority has a decision to allocate land to implement the project ".

Require detailed project progress development and multiple monitoring channels

To be more specific, before implementing the construction, the People's Committee of Thua Thien-Hue province also requires the investor to develop a detailed annual project schedule from the start date to completion (within 3 years) according to the gantt chart. And on the start date, the project must be made public so that residents can know and participate in supervising the implementation with the People's Committee of the province and relevant units.

Currently, the investor has not yet been handed over the clean site because many households have not yet moved.

At the same time, the Provincial People's Committee will also request the Department of Construction to establish a team to monitor the progress and quality of the project; residents will also establish a community monitoring team (representative) to coordinate with the Department of Construction to monitor the progress and quality of the project. The Provincial People's Committee will, together with the monitoring team and residents, monitor the project's progress and handle delays (if any) according to the commitment (every 6 months, once a year).

Thua Thien-Hue Provincial People's Committee committed to directing functional units to regularly monitor and urge project implementation progress.

Regarding the agreement and commitment documents on the handover of apartments and premises, information from the People's Committee of Thua Thien - Hue province has assigned the People's Committee of Hue City to have a written commitment to ensure the temporary residence time, construction quality, project progress... to households with temporary residence requests so that the investor can hand over the house within 36 months. At the same time, a plan to sign the handover of the Certificate of land use rights and assets on the land to households will be made with the following components: Hue City People's Committee, Hue City Land Fund Development Center and related households.

Even in case of force majeure, progress must be ensured within 36 months.

In case the investor is late in handing over the apartment, the People's Committee of Thua Thien-Hue province, in addition to considering penalties according to the law, will force the investor to fulfill its commitment to the People's Committee of the province, the People's Committee of Hue city and the households to pay temporary housing support equal to 2.5 times the support amount approved by the People's Committee of Hue city. Specifically, 4 million VND/apartment/month multiplied by 2.5 times equals 10 million VND/apartment/month multiplied by the number of months when the handover of the resettlement apartment is delayed.

Regarding the case of delayed handover due to force majeure (objective) factors, the People's Committee of Thua Thien-Hue province also affirmed that the investor must still implement the project to ensure it is within the committed 36-month schedule.

In addition, in the document sent to households, the Vice Chairman of the People's Committee of Thua Thien-Hue province also said that in order to ensure project progress, ensure the safety of residents' lives, contribute to creating urban beauty and from legal bases, it is agreed to maintain the compensation, support and resettlement plan approved by the Provincial People's Committee in Decision No. 2139/QD-UBND dated August 28, 2021, approved by the People's Committee of Hue City in Decisions No. 3404/QD-UBND dated May 10, 2023 and Decision No. 3404/QD-UBND dated August 3, 2023.

"In case the remaining households do not agree, the organization will enforce land recovery and forced relocation according to the provisions of the law on land, housing and other relevant laws," the Vice Chairman of the People's Committee of Thua Thien-Hue province affirmed in the document.

The project to renovate and rebuild blocks A, B, C of Dong Da apartment complex with a total investment capital of nearly 1,300 billion VND is invested by Dong Da Development and Investment Joint Stock Company.

The investor is expected to start the project in September this year. However, to date, the site clearance work to hand over the clean site to the investor has not been completed because nearly 30 households have not agreed to move.

Currently, the project investor is very worried and hopes that the local government and related units will take more drastic actions because Hue is about to enter the rainy season. If construction and dismantling are organized during the rainy season, it will incur additional costs as well as the safety of the workers, and at the same time affect the progress committed to the locality and the people.

According to information from the Hue City Land Fund Development Center, this September, they will organize a final mobilization and dialogue with the remaining households. Along with that, the unit will also develop a plan to enforce against households that refuse to hand over the land to implement the project.

Currently, conditions have been ensured to organize forced land acquisition and forced relocation in case the remaining households do not agree with the approved compensation, support and resettlement plan.
