After the report of Chairman of the Committee on Science, Technology and Environment Le Quang Huy, the Standing Committee of the National Assembly focused on discussing the responsibility of the Minister of National Defense for state management of digital signatures for public service; state management of digital signatures for public service; the responsibility of the Ministry of Information and Communications and related ministries and branches in managing electronic transaction activities but must ensure decentralization and delegation of authority; digital signature certification services for public service, public electronic certification; methods of electronic transactions; state management of databases in electronic transactions...
Concluding the session, National Assembly Chairman Vuong Dinh Hue requested the National Assembly Standing Committee to submit a report to the Government for comments. If consensus is reached, the draft Law on Electronic Transactions (amended) will be submitted to the National Assembly for approval at the 5th session.
Regarding the structure of the draft law, the National Assembly Chairman requested the drafting agency to review the state management function. In state management, the Government unifies state management of electronic transactions. The Ministry of Information and Communications is the focal agency to assist the Government in performing the state management function. The state management responsibility of the Minister of National Defense for digital signatures used exclusively for public service; how relevant ministries and branches carry out the management also needs to be clearly mentioned. Absolutely do not confuse the state management function with the provision of public services.
The National Assembly Chairman noted that the agencies should re-edit Article 31 on trust services and provide specific instructions. In addition, regarding other contents in the document of acceptance and explanation, the National Assembly Chairman requested the agencies drafting and reviewing the draft law to accept the comments of the members of the National Assembly Standing Committee; assign the Committee on Science, Technology and Environment to develop a report, accept and explain, and send it to the National Assembly Standing Committee for consideration and comments.
The Standing Committee of the Science, Technology and Environment Committee found that: Regarding state management practices, the Ministry of Information and Communications is the focal agency responsible to the Government for state management of electronic transactions from 2005 to present, including digital signatures. The Government Cipher Committee has been assigned to provide specialized digital signature certification services for agencies in the political system from 2007 to present. Therefore, the provisions in Article 7 of the draft law are consistent with current laws and state management practices on electronic transactions.
To ensure compliance with the scope of the draft law, Article 15 of the draft law only stipulates technical requirements and methods of conversion between paper documents and data messages that must be met and referred to relevant legal provisions, and at the same time assigns the Government to specify this content in detail. |
The Standing Committee of the Science, Technology and Environment Committee found that it is necessary to maintain the regulations on the responsibilities of ministries, ministerial-level agencies, the Minister of National Defense, and provincial People's Committees in Clauses 2 and 3, Article 7 of the draft law to ensure that electronic transactions are managed comprehensively and fully in all fields, in accordance with the provisions of law on electronic transactions and relevant laws.
Regarding the conversion between paper documents and data messages (Article 15), through research and review, the Standing Committee of the Science, Technology and Environment Committee found that the use value or legal value of the converted documents as well as the converting agencies and organizations have been stipulated in a number of relevant legal documents. To ensure compliance with the scope of the draft law, Article 15 of the draft law only stipulates the technical requirements, the method of conversion between paper documents and data messages must meet and refer to the provisions of relevant laws, and at the same time assigns the Government to specify this content in detail.
The National Assembly Standing Committee also gave opinions on a number of major issues in explaining, accepting, adjusting and perfecting the draft Law on Consumer Rights Protection (amended). After the report of the Chairman of the Committee on Science, Technology and Environment, the National Assembly Standing Committee focused on discussing civil cases on consumer rights protection with a transaction value of less than 100 million VND that are resolved under simplified procedures when meeting all the conditions specified in Article 70 of the draft law; protecting consumer rights in electronic transactions, on cyberspace and social networking platforms, online shopping; protecting consumers in banking and financial transactions such as when people deposit money in banks but it is converted into buying insurance; the responsibility of the board of directors, agencies, social organizations, and businesses in protecting consumer rights...
