On December 18, 2021, Hai Phong City People's Committee issued Decision No. 2219/QD-UBND approving the adjustment of the detailed planning at a scale of 1/500 at Hon Dau International Tourist Area. This is the basis for adjusting land allocation, construction and construction management records according to the approved planning.
The total area that Hon Dau International Tourism Joint Stock Company was assigned is 81,694 m² of water surface. However, since then, the investor has encountered many difficulties due to having to adjust the planning many times and changes in local policies and mechanisms.
The Hon Dau International Tourist Area project has a total investment capital of up to 1,500 billion VND, with an operating period lasting from 2005 to 2075.
Mr. Hoang Van Thieng, Director of Hon Dau International Tourism Joint Stock Company, said that the investor had to meet and work with many departments, agencies, and inspectors on issues such as not following regulations; building breakwaters outside the boundary; mobilizing capital not in accordance with regulations... But in reality, the Company is implementing according to the planning, this is a project that is assigned sea surface, not land. Regarding the dike part, the Company also built according to the detailed planning 1/500 and did not build incorrectly, so there is no such thing as exceeding the boundary.
Regarding capital mobilization, Mr. Hoang Van Thieng said that Decision No. 259/QD-UBND dated February 19, 2007 of the Hai Phong City People's Committee clearly stated that Hon Dau International Tourism Joint Stock Company is responsible for mobilizing investment capital to build resort villas for sale under the business mechanism for secondary investors to use for tourism purposes according to the approved Detailed Planning and Construction Management Regulations. Thus, capital mobilization from secondary investors is completely in accordance with the policy of Hai Phong City.
When asked whether the company had filled in land beyond the assigned land boundary, Mr. Thieng said that the nature of the project was to encroach on the sea, the company followed the planning boundary, if they did not pour rocks to build a breakwater, this project would certainly be like carrying sand from the East Sea. There are places where the sea wall is nearly 20m deep. The police have issued a document concluding and verifying that the material or immaterial consequences related to this issue have not been determined.
According to the reporter's records, at present, many villas, hotels and resorts in the project are still under construction or abandoned. The investor said that it is not that they will not continue to implement but that they are still waiting for the completion of legal procedures. Previously, this project had not been updated in the general planning of Hai Phong City, causing construction activities to be temporarily suspended. In 2005, when the project was approved for investment, the Hai Phong City People's Committee had not yet asked for the opinion of the Standing Committee of the City Party Committee, forcing the investor to temporarily suspend construction of some items.
Currently, the Hai Phong City People's Committee has assigned the Department of Construction to coordinate with relevant agencies to advise and propose a report to the Ministry of Construction on allowing the project scope to be updated in the city's master plan adjustment, before submitting it to the Prime Minister for approval.
