Cases of temporary residence registration cancellation
Pursuant to Clause 1, Article 29 of the 2020 Law on Residence, people in one of the following cases will have their temporary residence registration deleted:
(1) Death; there is a court decision declaring missing or dead;
(2) There has been a decision to cancel temporary residence registration according to regulations;
(3) Continuous absence from temporary residence for 06 months or more without registering temporary residence at another place of residence;
(4) Has been given permission by a competent authority to renounce Vietnamese nationality, have Vietnamese nationality revoked, or have the decision to grant Vietnamese nationality revoked;
(5) Have been registered for permanent residence at the temporary residence;
(6) A person who has registered temporary residence at a rented, borrowed, or shared accommodation but has terminated the rental, borrowing, or shared accommodation without registering temporary residence at another accommodation;
(7) A person who has registered temporary residence at a legal place of residence but then the ownership of that place of residence has been transferred to another person, except in cases where the new owner agrees to allow him/her to continue living at that place of residence;
(8) Persons who register for temporary residence at a place of residence that has been demolished or confiscated by decision of a competent state agency or at a vehicle that has had its vehicle registration removed according to the provisions of law.
Documents and procedures for temporary residence registration cancellation
The dossier components and procedures for temporary residence registration cancellation are implemented according to the instructions in Article 8 of Decree 62/2021/ND-CP as follows:
(1) Within 01 day from the date of receipt of the decision to cancel temporary residence registration from the direct superior or immediately after issuing the decision to cancel temporary residence registration for a citizen, the residence registration agency shall cancel the temporary residence registration for the citizen and update the cancellation of temporary residence registration in the National Population Database and Residence Database.
(2) Except for the case in point (1), within 07 days from the date the household has a person subject to temporary residence registration deletion, the person subject to temporary residence registration deletion or the representative of the household is responsible for submitting the application for temporary residence registration deletion to the residence registration agency. The application for temporary residence registration deletion includes:
- Application form for change of residence information;
+ Documents and papers proving one of the cases of temporary residence registration cancellation.
(3) Agencies and units managing people studying, working and working in the people's armed forces shall have a written request for the residence registration agency in the stationed area to cancel the temporary residence registration of people under their management.
The proposal should clearly state:
- Last name, middle name and birth name;
- Citizen Identification Number or Identity Card of the person whose temporary residence registration needs to be deleted;
- Reason for requesting temporary residence registration cancellation.
(4) Within 02 working days from the date of receiving valid documents, the residence registration agency must delete the temporary residence registration for the citizen and update the deletion of temporary residence registration in the National Population Database and Residence Database.
(5) The residence registration authority shall cancel the temporary residence registration of a citizen when it discovers that the citizen falls into one of the cases of temporary residence registration cancellation.
Before deleting temporary residence registration, the residence registration agency shall notify the citizen or household representative of the deletion of temporary residence registration so that they are aware and can submit the application for deletion of temporary residence registration according to point (2).
In case after 07 days from the date of notification by the residence registration authority, the person subject to temporary residence registration deletion or the household representative does not submit the application for temporary residence registration deletion, the residence registration authority shall make a record of the citizen or household representative's failure to submit the application for temporary residence registration deletion and carry out temporary residence registration deletion for the citizen.
The residence registration authority shall notify in writing the citizen or head of household of the cancellation of temporary residence registration after it has been implemented.
