Increased staff to meet actual needs
Continuing the 6th session, on the afternoon of November 10, Minister of Justice Le Thanh Long, authorized by the Prime Minister, presented a report on the draft Law on the Capital (amended).
Regarding the capital's government, Minister Le Thanh Long said that the Government proposed implementing a model of not organizing ward People's Councils in Hanoi according to Resolution No. 97 and adding two cities to Hanoi.
Accordingly, Hanoi is expected to be established according to Resolution No. 15-NQ/TW in the North as a logistics and service city (Dong Anh, Me Linh, Soc Son areas); in the West it will be a city of education, training, and science (Hoa Lac, Xuan Mai areas).
Increase the number of People's Council delegates from 95 to 125 delegates, the proportion of full-time delegates from 20% to 25%, the number of Vice Chairmen of the People's Council (from 2 to a maximum of 3); expand the composition of the Standing Committee of the People's Council compared to the Law on Organization of Local Government to improve the capacity and increase the professionalism of the People's Council.
At the same time, regulate the organizational structure of the city government of Hanoi, with different characteristics compared to the district, town and city governments such as increasing the number of Vice Chairmen of the People's Council, People's Committee, full-time People's Council delegates, and adding the Urban Committee.

Regarding the organization, apparatus, cadres and civil servants of the Capital, it is proposed that the City People's Council establish, reorganize and dissolve specialized agencies and special administrative organizations under the People's Committee of Hanoi City, districts and towns. Hanoi will be allowed to increase its staff in accordance with actual needs.
Assign the Standing Committee of the Hanoi People's Council some authority such as deciding on measures to resolve urgent and unexpected work; deciding on adjusting investment policies for public investment projects of groups B and C.
Notably, similar to the mechanism applied to Ho Chi Minh City, the draft law stipulates additional income payments for cadres, civil servants, and public employees of agencies and units of the capital, and a number of central vertical agencies located in the area to perform political tasks in the locality, with the total expenditure not exceeding 0.8 times the basic salary fund of cadres, civil servants, and public employees.
Decentralization from the Prime Minister to the Hanoi People's Committee to locally adjust the general planning for functional area construction, general urban planning, and specialized technical infrastructure planning (similar to what is being implemented in Ho Chi Minh City).
Move polluting facilities out of the inner city
Regarding environmental protection, the Government proposed that the city regulate the relocation of industrial production facilities that cause long-term environmental pollution or are labor-intensive, and medical facilities with high risks of infection and transmission out of historical inner-city areas and central urban areas.
Allow support and incentives for purchasing and converting vehicles from using fossil fuels to using clean energy.

The draft law also adds three areas in which Hanoi is allowed to impose fines higher than but not more than twice the general fines prescribed by the Government, including fire prevention and fighting, food safety and hygiene, and advertising.
Regarding finance and budget, Hanoi can borrow through issuing local government bonds, borrowing from financial institutions, other domestic organizations and from government bonds issued regardless of the ceiling limit.
The city budget retains the maximum amount of land use fees and land rents under the city's management authority to create resources for investment in key projects, PPP projects, public transport, and support for relocation of facilities and units on the list of those that must be relocated.
According to the meeting agenda, the National Assembly will discuss the draft law on the amended Capital this afternoon (November 10). The draft law is expected to be passed by the National Assembly at the 7th session in mid-2024 .
