
Rampant violations
On National Highway 40B, the road safety corridor has been encroached upon by people, organizations, and businesses by building tents, fences, gates, and consolidating the existing residential road surface.
Besides, the erection of billboards; leveling of land, encroachment on corridors, gathering of materials within the road safety corridor; illegal connections; and embankments are occurring frequently.
Along other national highways and provincial roads, there have been no effective measures to correct the encroachment on road safety corridors, especially National Highway 14D (through Nam Giang district).
Mr. Truong Van Son - Chief Inspector of the Department of Transport said that in 2023, the unit detected and handled 150 cases of violations of road safety corridors on national highways and provincial roads. Of which, on National Highway 14D alone, the authorities detected 54 cases with signs of violations.
In the first two months of 2024, 8 related incidents occurred on Highway 14D. Violations of road safety corridors have damaged infrastructure; affected the quality and operation of the route; and created potentially dangerous sections of the route, "black spots" for traffic accidents.

According to the Inspector of the Department of Transport, the above situation occurred, in addition to objective causes, due to the low awareness of law compliance of some people, businesses and organizations.
Authorities in some localities have not paid due attention and fully implemented their responsibilities for protecting road traffic infrastructure according to the provisions of law and regulations on coordination in handling violations of national highways and provincial roads in Quang Nam. The functional units and the Department of Transport have sent many documents to localities to urge handling, but they have not been implemented promptly.
Mr. Truong Van Son said that some routes currently in operation have not yet reclaimed the entire land area for roads (including road land and road safety corridor land).
This leads to violations due to construction works located within the road safety corridor, but on land that has been granted a red book by a competent authority.
The management of land records and data in some localities still has many problems. Red book data has not been revised or updated according to the actual situation, making it difficult to detect and handle violations.
Meanwhile, handling violations only stops at administrative sanctions or temporarily closing and stopping construction to give violators time to complete necessary legal procedures.
Not yet forced to remedy the consequences according to the provisions of law in cases of non-voluntary remedy and the deadline for the decision to apply forced remedial measures issued by the competent authority has expired.
The dissemination and popularization of laws and related documents on protection and management of road infrastructure are not widespread enough for people to understand and comply, especially in mountainous areas.
Promote responsibility
Captain of Traffic Inspection Team No. 1 (Department of Transport Inspectorate) - Mr. Thai Minh Hoang said that in order to rectify the above situation, it is necessary to first strengthen the propaganda and dissemination of legal regulations on protecting road traffic infrastructure.

In particular, disseminate the content of "Regulations on coordination in handling violations in the management and protection of road traffic infrastructure in Quang Nam province" according to Decision No. 2117 (dated October 5, 2023 of the Provincial People's Committee) to local authorities at the commune level and people living along the roads.
Organize training for traffic staff of the People's Committee at the commune level on how to identify subjects, violations and handling procedures according to issued regulations.
Mr. Son said that the unit will advise the Department of Transport to urge the People's Committees at the commune and district levels to strengthen inspection, detection and handling of violations of regulations on protection of road traffic infrastructure according to coordination regulations and relevant legal provisions.
Authorities at all levels need to strictly handle officials and civil servants who fail to perform or are irresponsible in performing assigned tasks.
The Department of Transport will continue to direct road management and maintenance units to strengthen monitoring of the remediation of consequences caused by administrative violations, promptly report to relevant agencies to have a plan to organize enforcement according to regulations.
The transport sector applies information technology to detect early and take measures to prevent new violations from the beginning in order to conveniently handle and apply remedial measures.
