On the afternoon of February 7, at the 42nd Session, the National Assembly Standing Committee passed a Resolution approving the proposal of the Chief Justice of the Supreme People's Procuracy on the working apparatus of the Supreme People's Procuracy.

Presenting a report, Deputy Chief Justice of the Supreme People's Procuracy Ho Duc Anh proposed that the National Assembly Standing Committee approve the termination of operations, merger and rearrangement of a number of department-level units under the Supreme People's Procuracy.

Specifically, the Department of Prosecution and Investigation Supervision of Economic Cases (Department 3) and the Department of Prosecution and Investigation Supervision of Corruption and Position Cases (Department 5) will be merged into the "Department of Prosecution and Investigation Supervision of Economic and Corruption Cases".

In addition, the Supreme People's Procuracy also merged the Hanoi University of Procuracy (T2) and the School of Training and Fostering Procuracy Profession in Ho Chi Minh City (T3) into the "University of Procuracy", with a Branch of the University of Procuracy in Ho Chi Minh City.

At the same time, the activities of the Emulation and Reward Department were ended and the tasks were transferred to the Office of the Supreme People's Procuracy.

Restructure and reorganize the Department of Legislation and Science Management and the Procuracy Magazine into two units: the Department of Legislation and the Institute of Procuracy Science.

In addition, edit the names of some units under the Supreme People's Procuracy, ensuring they are concise and general but still fully reflect the functions and tasks of the unit.

Examining this content, Chairwoman of the Judicial Committee Le Thi Nga said that the Central Party Office and the Politburo "basically agree with the review, arrangement, and restructuring of the organization and apparatus in the People's Procuracy sector".

Therefore, the Standing Committee of the Judiciary Committee approved the proposal of the Chief Justice of the Supreme People's Procuracy to terminate the operation, merge and rearrange a number of Department-level units under the Supreme People's Procuracy.

After discussion, 100% of the members of the National Assembly Standing Committee passed a resolution approving the proposal of the Chief Justice of the Supreme People's Procuracy on the organization of the Supreme People's Procuracy.

Accordingly, the Supreme People's Procuracy has 24 units including 14 departments: Prosecution and Investigation of Security Cases; Prosecution and Investigation of Social Order Cases; Prosecution and Investigation of Economic and Corruption Cases; Prosecution and Investigation of Drug Cases; Prosecution and Investigation of Judicial Cases; Prosecution and Investigation of Criminal Trials; Prosecution of Detention and Execution of Criminal Sentences; Prosecution of Civil Cases; Prosecution of Administrative and Commercial Cases; Prosecution of Civil Sentence Execution; Prosecution of Judicial Complaints and Denunciations; International Cooperation and Mutual Legal Assistance in Criminal Matters; Legislation; Organization and Personnel.

In addition, the Supreme People's Procuracy also has: the Procuracy Committee; Office; Supreme People's Procuracy Investigation Agency; Department of Crime Statistics and Digital Transformation; Department of Finance; Inspectorate; University of Procuracy (with a branch of the University of Procuracy in Ho Chi Minh City); Institute of Procuracy Science; Law Protection Newspaper; Central Military Procuracy.

This Resolution comes into force from the date of its adoption.

The examining agency said that there were opinions that the draft resolution removing the regulation on the limit on the number of deputy heads of the Supreme People's Procuracy and deputy heads of departments, divisions, and offices under the Supreme People's Procuracy's working apparatus could easily lead to the understanding that the Supreme People's Procuracy will no longer have a limit on the appointment of the number of deputy heads.

In the context of implementing the Party's policy on streamlining the apparatus and staff, this opinion suggests that it is necessary to retain the regulation on the number of deputies in the draft resolution but add special cases due to the rearrangement of the apparatus to implement the Party's policy. In case this content is not further regulated in the draft resolution, it must be regulated in another document of the competent state agency.
