With 85.63% of National Assembly deputies voting in favor, on the morning of November 27, the National Assembly passed the Housing Law (amended) project.
Previously, the explanation and acceptance report presented by Chairman of the Law Committee Hoang Thanh Tung stated that, regarding the subjects eligible to rent public housing (Article 45), there was a proposal to add to point d, clause 1, Article 45 the subjects eligible to rent public housing are: people working in secret service, civil servants, workers and national defense officials mobilized, rotated, seconded according to national defense, security, and secret service requirements regardless of the work area; people working in other secret service organizations mobilized, rotated, seconded to work in remote areas.

The National Assembly Standing Committee (NASC) believes that, compared to the current Housing Law, the draft law submitted by the Government at the 5th Session has added the subject of "non-commissioned officers of the people's armed forces" to be allowed to rent public housing. Incorporating the opinions of the National Assembly deputies and the Government, the draft law submitted by the NASC to the National Assembly at the Hall discussion session on October 26, 2023 has expanded the subjects of the people's armed forces and key organizations to be allowed to rent public housing.
Accordingly, people working in cryptography and other jobs in cryptographic organizations who are officers, professional soldiers, and non-commissioned officers of the People's Army and the People's Public Security Forces are eligible to rent public housing when they are mobilized, rotated, or seconded according to national defense and security requirements.
If we continue to add and expand the subjects as proposed above while the state resources for developing public housing are still difficult, it will be difficult to ensure feasibility. Report No. 642 dated November 16, 2023 of the Government has not yet clarified the state budget needed to invest in building a public housing fund to meet the expansion of the scope of subjects eligible to rent public housing.

In addition, the addition of subjects eligible to rent public housing according to the above proposal will affect the balance and consistency of public housing policies for other groups of subjects in the political system, because according to the provisions of Clause 1, Article 45 of the draft law, cadres and civil servants must hold certain positions, such as at the Central level, they must be Deputy Head of a Government agency and equivalent or higher, at the local level, they must be Vice Chairman of the District People's Committee, Deputy Director of a Department and equivalent or higher to be eligible to rent public housing.
For cadres, civil servants and public employees of public agencies and units of the Party, State and socio-political organizations who do not hold positions, they are only allowed to rent public housing when they are mobilized, rotated or seconded to work in remote communes, areas with especially difficult socio-economic conditions, border areas and islands.
"For the above reasons, the Standing Committee of the National Assembly proposes that in the current period, only a reasonable expansion of the subjects eligible to rent public housing should be made in accordance with the capacity of the public housing supply. Later, when conditions permit, further expansion will be considered and continued," explained Chairman of the Law Committee Hoang Thanh Tung.

Accordingly, the acceptance and adjustment of Point d, Clause 1, Article 45 as in the draft law is appropriate; at the same time, to ensure comprehensiveness and flexibility in handling special cases that may arise in practice, the Standing Committee of the National Assembly would like to accept and adjust Point g, Clause 1, Article 45 of the draft Law as follows: "(g) Based on actual conditions, the Prime Minister decides that subjects not falling under the cases specified in Points a, b, c, d, dd and e of this Clause shall be arranged for public housing at the request of the Ministry of Construction on the basis of synthesizing proposals from ministries, agencies, organizations at the central level, and provincial People's Committees".
The Vietnam General Confederation of Labor is the governing body of social housing construction investment projects.
Regarding the regulation that the Vietnam General Confederation of Labor is the governing body of social housing construction investment projects (Clause 4, Article 80), the Standing Committee of the National Assembly would like to accept the opinions of the majority of National Assembly deputies and revise the draft law in the direction of stipulating that the Vietnam General Confederation of Labor is the governing body of social housing construction investment projects for workers and laborers to rent to supplement resources for investment in social housing development; promote the role and responsibility of the Vietnam General Confederation of Labor in caring for and ensuring social security, especially the right to housing, improving the quality of life and attracting workers and laborers to participate in the Trade Union organization.
This plan has received high consensus among the Standing Committee of the National Assembly, the Government, the Vietnam General Confederation of Labor and the majority of opinions of the National Assembly Deputies; it has been revised on the basis of absorbing the opinions of the National Assembly Deputies after the 5th Session, ensuring strictness, synchronization, high implementation effectiveness, and removing obstacles in the previous pilot practice according to the Prime Minister's Decision because it was not yet regulated by law.
