Specifically, New Year 2025 falls on Wednesday, so civil servants, public employees, and workers will have 1 day off with full pay.
According to Article 107 of the 2019 Labor Code, employers are allowed to have employees work overtime on New Year's Day, but must meet the following requirements:
Must have the consent of the employee;
Ensure that the number of overtime hours of employees does not exceed 50% of the normal working hours in 1 day. In case of applying the regulation on normal working hours per week, the total number of normal working hours and overtime hours does not exceed 12 hours in 1 day.
When employees work overtime on New Year's Day, they will be paid at least 300% overtime pay, not including holiday pay, paid leave for employees receiving daily wages.
Workers working at night are paid an additional amount of at least 30% of their wages calculated according to the unit price of wages or actual wages paid for the work of a normal working day.
Thus, the 2025 New Year holiday schedule for officials, civil servants, and employees is 1 day (January 1, 2025). When employees work overtime during the day of New Year's Day, they will be paid at least 300% of their salary. When employees work overtime at night on New Year's Day 2025, they will be paid an additional 390% of their salary.
Article 112 of the 2019 Labor Code stipulates that in a year, employees have a total of 11 days off for holidays and Tet and receive full pay. These are the following days: New Year's Day 1 day (January 1); Lunar New Year 5 days; Victory Day 1 day (April 30); International Labor Day 1 day (May 1); National Day 2 days (September 2 and 1 day before or after); Hung King's Commemoration Day 1 day (March 10 of the Lunar calendar).
In case a holiday or Tet holiday coincides with a weekly day off, employees will be given a compensatory day off on the following day.
For foreigners working in Vietnam, in addition to the holidays prescribed in the 2019 Labor Code, they are also entitled to 1 day off for their traditional New Year and 1 day off for their country's National Day.
