The Capital Law is an important legal document regulating the position, role, responsibility and policies for building, developing and protecting the Capital. However, after more than 10 years of implementing the Capital Law, the implementation of a number of goals, solutions and regulations set out in the Law still has many shortcomings and limitations, requiring the need to develop a revised Capital Law.
The amendment of the Law closely follows the political, legal and practical foundations on the construction, protection and development of the Capital in order to promptly institutionalize the policies, requirements and tasks set out in the Central Resolutions, especially Resolution No. 15-NQ/TW dated May 5, 2022 of the Politburo on the direction and tasks of developing the Capital Hanoi to 2030, with a vision to 2045, and to solve practical problems arising in the construction, protection and development of the Capital...
The draft Law consists of 7 chapters and 59 articles (an increase of 3 chapters and 32 articles compared to the 2012 Capital Law, of which 3 articles are kept the same; 18 articles are amended and supplemented; and 38 articles are newly stipulated).
The documents of the 13th National Party Congress for the first time established important guiding viewpoints on three pillars of foreign affairs, in which the pillar of "People's diplomacy" together with the two pillars of "Party diplomacy" and "State diplomacy" create a unified foreign front, forming a modern and comprehensive Vietnamese diplomacy.
Recognizing the importance and responsibility of implementing the City's assignment in contributing opinions to the contents of the draft Law on the Capital (amended), the Hanoi Union has established the Capital People's Foreign Affairs Advisory Council, consisting of experts with many years of experience in law-making and holding important responsibilities in the field of diplomacy in general and people's foreign affairs in particular.
With the comments contributed to Clause 2, Article 52, draft Law on Capital (amended) dated May 10, 2024, the organization of the Seminar aims to clarify the content of the above 3 groups of policy mechanisms related to the concretization and implementation of the Law on Capital (amended): Group 1: Legal status, organizational structure, job positions, payroll; Group 2: Financial mechanism to ensure people's foreign affairs activities; Group 3: Policy mechanism to develop networks, organizations, and forces for people's foreign affairs.
Article 52 stipulates in Clause 2: Proactively and actively expand relations and friendly cooperation with the capitals of other countries, mobilize external resources to build and develop the Capital; strengthen people-to-people diplomacy, create favorable conditions for agencies, organizations and people of the Capital to participate in international exchange and cooperation activities in the fields of economics, culture - society, education, science and technology.
The Government and People of Hanoi believe that the Law on the Capital (amended) will truly ensure legal conditions for Hanoi to become more and more worthy of being the heart of the whole country, the Heroic Capital, the City for Peace, the City of "Cultured - Civilized - Modern".
