Amending regulations on business conditions for karaoke and dance hall services

The Government has just issued Decree No. 148/2024/ND-CP amending and supplementing a number of articles of Decree No. 54/2019/ND-CP of the Government regulating karaoke and discotheque business.

Regarding the conditions for karaoke service business, Decree No. 148/2024/ND-CP amends regulations on ensuring conditions for fire prevention and fighting and security and order as follows:

Ensure the conditions of Fire prevention and security and order as prescribed in Decree No. 96/2016/ND-CP dated July 1, 2016 of the Government stipulating conditions on security and order for a number of conditional investment and business sectors and professions and Decree No. 56/2023/ND-CP dated July 24, 2023 of the Government amending and supplementing a number of articles of Decree No. 96/2016/ND-CP dated July 1, 2016 stipulating conditions on security and order for a number of conditional investment and business sectors and professions, Decree No. 99/2016/ND-CP dated July 1, 2016 on the management and use of seals, Decree No. 137/2020/ND-CP dated November 27, 2020 stipulating the management and use of fireworks.

For discotheque business, it is necessary to ensure conditions on fire prevention and fighting and security and order according to the provisions of Decree No. 96/2016/ND-CP and Decree No. 56/2023/ND-CP of the Government.

Decree No. 148/2024/ND-CP also supplements the general responsibility of enterprises and business households when operating karaoke services and discotheque services to ensure compliance with the provisions of QCVN 06:2022/BXD National technical regulations on Fire safety for houses and structures issued together with Circular No. 06/2022/TT-BXD dated November 30, 2022 of the Minister of Construction, Amendment 1:2023 QCVN 06:2022/BXD National technical regulations on Fire safety for houses and structures issued together with Circular No. 09/2023/TT-BXD dated October 16, 2023 of the Minister of Construction, standards, technical regulations, regulations related to fire safety, load-bearing safety for houses and structures and fire prevention and fighting at karaoke and discotheque service establishments.

In case of organizing performing arts activities, it shall be implemented in accordance with the provisions of Decree No. 144/2020/ND-CP dated December 14, 2020 of the Government regulating performing arts activities.

Amending regulations on the authority to grant, adjust and revoke licenses for eligibility to operate karaoke services or discotheque services

Decree No. 148/2024/ND-CP amends and supplements the provisions on "Authority to grant, adjust and revoke Licenses for eligibility to conduct karaoke services or discotheque services" as follows:

Provincial People's Committees have the authority to grant, adjust and revoke Business Eligibility Certificates. karaoke service or discotheque services (called Business Eligibility License).

The Department of Culture, Sports and Tourism or the Department of Culture and Sports receives and manages records and business eligibility licenses under the licensing authority of the Provincial People's Committee.

The decentralization and authorization of procedures for granting, adjusting and revoking Business Eligibility Certificates shall comply with the provisions of law on local government organization. Procedures for granting Business Eligibility Certificates The Decree amends and supplements the provisions on "Procedures for granting Business Eligibility Certificates" as follows:

Enterprises or business households shall submit directly or by post or electronically a set of documents as prescribed to the document receiving agency.

In case the dossier is not in accordance with regulations, within 1 working day from the date of receipt of the dossier, the dossier receiving agency shall issue a written notice requesting completion of the dossier.

In case the dossier is complete as prescribed, within 3 working days from the date of receipt of the dossier, the agency issuing the Business Eligibility Certificate shall appraise the dossier, establish a Team to appraise the actual business location (hereinafter referred to as the Appraisal Team) on the business conditions prescribed in this Decree to advise the competent authority issuing the Business Eligibility Certificate to decide whether or not to issue the Business Eligibility Certificate. The Appraisal Team shall consist of no more than 7 members, including representatives of the following agencies: Public Security, Culture, Construction and other relevant agencies.

Within 4 working days from the date of establishment, the Appraisal Team shall organize the appraisal and issue the appraisal results according to Form No. 06 in the Appendix attached to this Decree.

Within 3 working days from the date of assessment results, the authority issuing the Business Eligibility Certificate shall be responsible for issuing the Business Eligibility Certificate according to Form No. 02 in the Appendix to this Decree or not issuing the Business Eligibility Certificate. In case of not issuing the Business Eligibility Certificate, a written response must be given stating the reasons.

The competent authority that issues the Business Eligibility Certificate shall send 1 copy of the Certificate to the enterprise or business household that is granted the Business Eligibility Certificate, the authority that issues the Business Registration Certificate or Business Household Registration Certificate, the district-level police agency where the business is conducted, and keep 1 copy of the Certificate at the authority that issues the Business Eligibility Certificate, the agency that receives the application, and post it on the website of the authority that issues the Business Eligibility Certificate.
