Some opinions say that it should be absolutely banned according to the Government's proposal. Meanwhile, some other opinions state that drinking alcohol above the permitted limit should be banned and punished.

In the hallway of the National Assembly, talking to Nguoi Dua Tin , National Assembly Deputy Pham Van Hoa - Member of the Law Committee said that the regulation that traffic participants, especially drivers, are not allowed to use alcohol is an issue that many delegates are concerned about.

"People are very supportive and I myself agree that driving is not allowed to drink alcohol," said delegate Hoa.

However, the delegate said that the regulation on alcohol concentration for drivers after being tested for syrup in their breath is not appropriate. Therefore, regarding the alcohol concentration measurement of "0", the delegate said that he would argue about this content, which is "We must accept that the breath has alcohol concentration but it must be within certain limits according to the provisions of the law".

Mr. Hoa explained that nowadays there are many cases where food and seasoning processors use a little alcohol.

“After eating, getting in the car and then measuring the alcohol concentration and being fined is not guaranteed. This is a problem. Furthermore, there are cases where they drink alcohol but rest for several hours. Even if they drink from this afternoon, go home to rest, sleep until tomorrow morning to go to work, I am sure that when measuring the alcohol concentration, these cases still have alcohol in their breath,” said Mr. Hoa.

Mr. Hoa once again emphasized, “The regulation of not being allowed to drink alcohol is correct, but there must be clear and specific regulations on the alcohol concentration in the breath of the driver. This will ensure safety.”

The delegate also gave an example, drinking half a bottle of beer or a bottle of beer, or a glass of wine for ceremonial purposes is already a bit of alcohol. "But if you drink that much, I think it is impossible to get drunk enough to lose control of the wheel," Mr. Hoa said.

At the same time, according to Mr. Hoa, it should also be assessed that not all current traffic accidents are caused by drivers who have drunk alcohol or beer. Because, traffic accidents can occur in many situations, including those where drivers do not drink alcohol or beer.

Therefore, the delegate said that it is necessary to have a truly objective assessment of this issue, paying attention to rural culture, ethnic groups, holidays, etc.

Mr. Huan gave an example in Finland, if you drink 1 bottle of beer within 1 hour, the stimulant will no longer have enough effect and you can drive. If you drink 2 bottles of beer, you can drive after 3 hours.

"In our country, it is absolutely forbidden. For example, last night we had a party, but this morning the concentration was still there and we violated. That is not realistic. Last night we drank a little, this morning we were still sober at the meeting, we still spoke, so what's the problem?", Mr. Huan said.

In response to the opinions and proposals of delegates in recent times, informing the press about some contents related to the draft Law, Major General Pham Cong Nguyen - Director of the Department of Legislation and Administrative and Judicial Reform, Ministry of Public Security said that, with the viewpoint of protecting the lives of traffic participants above all, Clause 1, Article 8 of the current draft Law on Road Traffic Order and Safety stipulates that driving a vehicle while having alcohol concentration in the blood or breath is one of the prohibited acts.

This regulation aims to limit traffic accidents, ensure the health of traffic participants and is consistent with the provisions of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer (Clause 6, Article 5 stipulates that driving a vehicle with alcohol concentration in the blood or breath is a prohibited act).

In fact, drivers who drink alcohol are often affected in their health, mental and physical health, and their ability to judge and handle situations when participating in traffic; there have been many traffic accidents with serious consequences, killing and injuring many people, the cause of which is the driver violating alcohol concentration regulations.

After a period of drastic implementation of controlling and handling violations of alcohol concentration, traffic accidents related to alcohol use have decreased significantly, proving the effectiveness of the above regulations in practice.

Therefore, the proposal to study the permissible alcohol concentration level suitable for each type of vehicle needs to be carefully studied and evaluated on the basis of ensuring practical requirements, having a scientific basis and ensuring feasibility.
