Real estate bosses who got into trouble with the law last year

Tran Qui Thanh

Mr. Tran Qui Thanh and his two daughters, Tran Uyen Phuong and Tran Ngoc Bich, are all senior leaders at Tan Hiep Phat Trading and Service Company Limited (Tan Hiep Phat Group). They were prosecuted in early April this year for the crime of abuse of trust to appropriate property. Mr. Thanh and Ms. Phuong were temporarily detained.

This decision to prosecute was made after the Ministry of Public Security's Investigation Police Agency (C01) investigated, verified, and resolved the content of the petitions of a number of citizens in Ho Chi Minh City and Dong Nai accusing these individuals of fraud, appropriation of property, abuse of trust, tax evasion, and extortion of property, which are projects and real estate of particularly great value in Dong Nai province and Ho Chi Minh City since November 2020.

The investigation results determined that, taking advantage of regulations on lending and transfer contracts, the chairman of Tan Hiep Phat Group and his two daughters, Tran Uyen Phuong and Tran Ngoc Bich, lent money to a number of people at interest rates "below the level that constitutes the crime of usury".

According to the investigation agency's accusation, from January 2019 to November 2020, the father and son of Tan Hiep Phat's chairman appropriated assets including 2 projects Minh Thanh, Nhon Thanh of Ms. Dang Thi Kim Oanh; 29 plots of land of Mr. Nguyen Van Chung; 4 plots of land of Mr. Lam Son Hoang and 2 plots of land of Mr. Nguyen Huy Dong. The total value of the assets is 767 billion VND.

The investigation agency said that the investigation so far has sufficient grounds to determine that the actions of Mr. Tran Qui Thanh and his daughters Tran Uyen Phuong and Tran Ngoc Bich constitute the crime of "abuse of trust to appropriate property".

Do Anh Dung

Mr. Do Anh Dung, Chairman of Tan Hoang Minh Group, and his son Do Hoang Viet were prosecuted and detained since 2022 to investigate the crime of Fraudulent appropriation of property. Last October, the Ministry of Public Security's Investigation Police Agency (C03) completed the conclusion to propose prosecuting Mr. Do Anh Dung and 14 others for the same crime.

The Chairman of Tan Hoang Minh Group was identified as the mastermind responsible for the embezzled money.

According to the investigation conclusion of the Ministry of Public Security, Mr. Dung and his subordinates committed fraud in 9 bond issuances, mobilizing a total value of 10,300 billion VND from investors against regulations. This amount of money was used by Tan Hoang Minh for business activities that were not in accordance with the bond issuance documents. The defendants returned the money to repay the victims.

During the investigation, C03 believed that the defendants Dung and Viet had confessed honestly and actively overcome the consequences, so they requested consideration when sentencing. Mr. Dung himself also had many achievements and contributions to society; participating in many recognized social charity activities.

Nguyen Khanh Hung

At the end of November, the Investigation Police Agency of Dong Nai Province Police prosecuted and temporarily detained Nguyen Khanh Hung (born in 1978, Chairman of the Board of Directors of LDG Investment Joint Stock Company) for the crime of Customer Fraud. Mr. Hung was identified as being involved in the illegal construction of 680 villas and townhouses (Tan Thinh residential area) in Doi 61 Commune, Trang Bom District, Dong Nai Province.

Previously, the Investigation Police Agency of Dong Nai Province Police decided to initiate a criminal case to investigate the crime of Abusing position and power while performing official duties, which occurred at the above project.

Mr. Nguyen Khanh Hung was prosecuted in connection with a project in Dong Nai.

Regarding this case, the Investigation Police Agency of Dong Nai Province Police has prosecuted the following suspects: Phan Duy Nghia, former Head of the Urban Management Department of Trang Bom District; Nguyen Hai Trieu, Deputy Head of the Urban Management Department of Trang Bom District; Nguyen Lan Hanh, Specialist of the Department of Natural Resources and Environment of Trang Bom District; Nguyen Van Nhat Huy, Specialist of the Urban Management Department of Trang Bom District and Luong Quang Huy, former Deputy Head of the Urban Management Department of Trang Bom District, Chairman of the People's Committee of Giang Dien Commune, Trang Bom District.

The above defendants were prosecuted for the crime of Abusing positions and powers while performing official duties. This is a case under the supervision and direction of the Central Steering Committee on Anti-Corruption and Negligence.

After the incident, LDG Company dismissed Mr. Nguyen Khanh Hung from his position as Chairman of the Board of Directors. At the same time, the company appointed Mr. Ngo Van Minh as Chairman of the Board of Directors and Mr. Tran Cong Luan, Deputy General Director, as General Director.

The company also said that the incident will not change or affect the company's plans, strategies, production, business and investment activities. The legitimate rights and interests of customers, shareholders and partners will still be guaranteed.

Nguyen Cao Tri

Mr. Nguyen Cao Tri, General Director of Saigon - Dai Ninh Company, was prosecuted and temporarily detained for allegedly appropriating 40 million USD from Ms. Truong My Lan (Chairman of the Board of Directors of Van Thinh Phat Group).

According to the police investigation agency's report, during the process of expanding the investigation into the Van Thinh Phat case, the agency discovered that Ms. Truong My Lan had a business and investment relationship with Mr. Nguyen Cao Tri.

According to the investigation conclusion of the case at Van Thinh Phat Group, Mr. Nguyen Cao Tri was proposed by the Ministry of Public Security's Investigation Police Agency to be prosecuted for the crime of Abuse of trust to appropriate property. Mr. Tri received money from Ms. Lan many times through the assistants of the Chairman of Van Thinh Phat, the total amount of money was about 1,000 billion VND.

But then, Mr. Tri arbitrarily created and completed the documents to liquidate the transfer contract and liquidate the investment trust contract worth 1,000 billion VND without discussing with Ms. Lan in order to appropriate the 1,000 billion VND he had received.

Initially, Mr. Tri denied receiving money from Ms. Lan and sent petitions to many places to confirm the above. Later, Mr. Tri admitted to his crime and sent a petition to his family to pay compensation for the consequences, and the family paid 640 billion VND into the temporary account of the investigation agency.

According to the investigation conclusion, the Ministry of Public Security seized Mr. Tri's assets during the search; seized 7 real estates (worth more than 266 billion VND) of Mr. Tri; the defendant's family voluntarily paid to compensate for the consequences. Total of more than 1,001 billion VND.

Dinh Truong Chinh

Ho Chi Minh City police said the security investigation agency has initiated a case and prosecuted Mr. Dinh Truong Chinh (former director of Viet Han Trading - Advertising - Construction - Real Estate Company Limited) to investigate the crime of violating regulations on management and use of state assets causing loss and waste.

Along with Mr. Chinh, Mr. Huynh The Nang (former General Director of Southern Food Corporation - Vinafood 2) was also prosecuted for the above crime.

During the investigation, it was initially determined that Vu Thi Thuy (who had a previous conviction for Fraudulent Appropriation of Property) had provided false advertising information about the projects.

Ms. Thuy committed to paying interest rates of 34-46% to make people trust her to deposit money into the company, under the form of a business cooperation contract. Then, she took money from the latter to pay interest to the former.

Nghiem Van Minh

Mr. Nghiem Quang Minh (born in 1979, residing in Yen Hoa, Cau Giay, Hanoi) - the owner of this mini apartment building - was prosecuted and temporarily detained for 4 months from September 13 to investigate the crime of Violating regulations on fire prevention and fighting according to Article 313 of the Penal Code.

Later, the authorities discovered that Nghiem Quang Minh had built at least 8 mini apartment buildings in many districts of Hanoi. Of these, 6 were built in Thanh Xuan district, the remaining 2 were in Dong Da district and Tay Ho district. All of these apartments were located deep in small alleys, built on high floors, divided into many separate rooms for sale and rent, and did not meet fire prevention and fighting requirements.
