Circular No. 11/2023/TT-BNV guiding the adjustment of monthly allowance levels for retired elderly commune-level cadres takes effect from September 15.

Accordingly, increase pension, social insurance allowance, monthly allowance for elderly commune cadres as follows: Monthly allowance = Allowance level for June 2023 x 1.125.

After adjustment, if the subsidy level of retired old communal cadres is lower than 3 million VND/month, it will continue to be adjusted, specifically:

Increase by 300,000 VND/person/month if the benefit level is less than 2.7 million VND/month/person.

Increase by 3 million VND/person/month if the benefit level is from 2.7 to less than 3 million VND/person/month

The specific subjects whose monthly allowances are adjusted are rounded as follows: Former Party Committee Secretary, Chairman of the People's Committee, Deputy Secretary, Vice Chairman, Standing Party Committee Member, Secretary of the People's Committee, Secretary of the Commune People's Council, Commune Team Leader, Commune Police Chief receive 3 million VND/month/person. The remaining positions receive 2.817 million VND/month/person.

Previously, the Government issued Decree No. 42/2023/ND-CP adjusting pensions, social insurance benefits and monthly allowances, effective from July 1.

Accordingly, from July 1, pensions, social insurance benefits and monthly allowances will increase from 12.5% ​​to 20.8%.

Increase by 12.5% ​​on pension, social insurance benefits and monthly allowances of June for subjects regulated by Decree No. 108/2021 of the Government adjusting pension, social insurance benefits and monthly allowances.

Increase by 20.8% on pension, social insurance benefits and monthly allowances of June for subjects not yet adjusted under Decree No. 108/2021.

According to Decree 42, people who are receiving pensions, social insurance benefits, and monthly benefits according to regulations, after adjustment, have a benefit level lower than 3 million VND/month, and will be adjusted to increase.

Specifically, an increase of 300,000 VND/person/month for those with a benefit level of less than 2.7 million VND/person/month.

Increase by 3 million VND/person/month for those with benefits from 2.7 million VND/person/month to less than 3 million VND/person/month.

In addition to the guidance on adjusting monthly allowances for retired elderly commune officials, in September 2023, many new policies for officials, civil servants, and public employees will also officially take effect.

Amending the criteria for classifying the quality of cadres, civil servants and public employees at the level of not completing their tasks

On July 17, 2023, the Government issued Decree 48/2023/ND-CP amending Decree 90/2020/ND-CP on assessment and classification of the quality of cadres, civil servants and public employees.

Accordingly, Clause 4, Article 1 of Decree 48/2023/ND-CP stipulates the removal of the phrase "in the process of performing tasks" in Clause 5, Article 7; Point c, Clause 1 and Point d, Clause 2, Article 11; Point c, Clause 1 and Point d, Clause 2, Article 15 of Decree 90/2020/ND-CP.

Thus, one of the criteria for classifying the quality of cadres, civil servants and public employees at the level of not completing their tasks is as follows:

There was a violation that was disciplined during the assessment year.

Decree 48/2023/ND-CP takes effect from September 15, 2023.

Supplementing guidelines for evaluating cadres and civil servants subject to Party discipline

Decree 48/2023/ND-CP also added guidance on evaluating cadres and civil servants subject to Party discipline as follows:

Cadres, civil servants and public employees subject to Party or administrative disciplinary action shall have their quality assessed and classified as follows:

a) Cadres, civil servants and public employees who are subject to party or administrative disciplinary action in the year of assessment shall be classified as having failed to complete their tasks, except for the case specified in Point b of this Clause.

b) In case the violation has not been subject to a disciplinary decision by a competent authority but has been used as a basis for assessing and classifying the quality as not completing the task in the assessment year, the disciplinary decision issued after the assessment year for that violation (if any) shall not be counted for assessing and classifying the quality in the year of the disciplinary decision.

c) In case a cadre, civil servant or public employee is a Party member and has been subject to Party disciplinary action and administrative disciplinary action for the same violation, but the Party disciplinary decision and the administrative disciplinary decision do not take effect in the same year of assessment, it will only be considered as a basis for quality classification in one year of assessment.
