Supplementing cases where transport business units have their License revoked

The Government issued Decree No. 41/2024/ND-CP amending and supplementing a number of articles of decrees related to the management of automobile transportation activities, automobile driver training services and driver testing services.

Compared to Decree 10/2020/ND-CP, the newly issued Decree 41/2024/ND-CP has added cases where transport business units have their business licenses revoked indefinitely.

Accordingly, the vehicle operator will have its license revoked if it fails to conduct all types of transportation business stated on the business license for a period of 6 months or more from the date of issuance of the business license or stops conducting all types of transportation business stated on the business license for a period of 6 consecutive months or more; fails to comply with the decision to inspect and examine the compliance with regulations on business and conditions for doing business in automobile transportation by competent authorities.

In addition, within 1 month, if 30% or more of the unit's vehicles are handled for violations, have their badges and signs revoked, their business licenses will also be revoked indefinitely.

Decree No. 41/2024/ND-CP takes effect from June 1, 2024.

Amending the Loan Conditions of the Small and Medium Enterprise Development Fund

The Government issued Decree 45/2024/ND-CP amending and supplementing a number of articles of Decree No. 39/2019/ND-CP dated May 10, 2019 on the organization and operation of the Small and Medium Enterprise Development Fund.

Regarding the principle of direct lending of the Small and Medium Enterprise Development Fund (Fund), Article 15 of Decree No. 39/2019/ND-CP stipulates: The Fund's lending activities are carried out according to the agreement between the Fund and small and medium enterprises, in accordance with the provisions of this Decree; Small and medium enterprises borrowing capital from the Fund must ensure that the loan capital is used for the right purpose, repaying the principal and interest of the loan in full and on time as agreed with the Fund; The currency for lending and repayment is Vietnamese Dong.

In addition to the above 3 principles, Decree 45/2024/ND-CP adds the following principle: Enterprises that have borrowed capital from the Fund will be considered for loans for new projects and production and business plans from the Fund's capital if the enterprise has fully repaid the principal and interest of the loan in full and on time.

This principle aims to limit a business from borrowing capital for many projects and production and business plans at the same time. At the same time, after the business has fully paid back, there will be enough basis to evaluate the results, efficiency, ability and real need for support next time.

In addition, Decree 45/2024/ND-CP also amends and supplements Clauses 1, 2, and 3, Article 16 on loan conditions.

Transfer of the right to collect fees for using road infrastructure assets for a maximum of 10 years

The Government issued Decree No. 44/2024/ND-CP regulating the management, use and exploitation of road traffic infrastructure assets.

In particular, Decree 44/2024/ND-CP stipulates that the transfer of the right to collect fees for the use of road infrastructure assets is the State's transfer of the right to collect road usage fees to an organization under a contract to receive a corresponding amount of money. The scope of assets for which the right to collect fees for use is transferred is road infrastructure assets or a part of road infrastructure assets that are subject to road usage fees according to the provisions of law (except for road usage fees collected through vehicle heads according to the provisions of law on fees and charges).

The transfer of the right to collect fees for using road infrastructure assets does not apply to: Road infrastructure assets related to national defense and security; road infrastructure assets falling under the cases specified in Clause 1, Article 16 of Decree 44/2024/ND-CP.

The term of transfer of the right to collect fees for using road traffic infrastructure assets is specifically determined in each transfer contract but is a maximum of 10 years, in accordance with each asset (part of an asset) of road traffic infrastructure approved by the competent authority or person specified in Clause 5, Article 14 of Decree 44/2024/ND-CP in the Decision approving the Project on transfer of the right to collect fees for using assets.

5 criteria for awarding the title "Meritorious Artisan" in the handicraft profession

The Government issued Decree No. 43/2024/ND-CP dated April 19, 2024 detailing the awarding of the titles "People's Artisan" and "Meritorious Artisan" in the field of handicrafts.

The Decree, effective from June 6, 2024, details the subjects, standards, processes, procedures, and activities for considering and awarding the titles of "People's Artisan" and "Meritorious Artisan" in the field of handicrafts.

According to the Decree, the title "People's Artisan" in the field of handicrafts is awarded to individuals who have been awarded the title "Excellent Artisan" in the field of handicrafts and meet the following criteria: 1. Loyal to the Socialist Republic of Vietnam; strictly comply with the Party's guidelines, policies and laws of the State, regulations, rules and regulations of agencies, organizations and localities; 2. Have worked continuously in the handicrafts profession or have accumulated 20 years or more; 3. Have good moral qualities, be exemplary in life; be dedicated and devoted to the profession; be admired and respected by colleagues and the people; be a typical representative of the cause of protecting and promoting the value of cultural heritage in the field of handicrafts nationwide; 4. Have exceptionally excellent knowledge and skills.

The Decree clearly states that the Council for considering and awarding the titles of "People's Artisan" and "Meritorious Artisan" is established at each Council level (Provincial Council; Ministry-level specialized Council; State-level Council). Each time of awarding, the Councils will dissolve themselves after completing their tasks.

The Council for considering and awarding the titles of "People's Artisan" and "Meritorious Artisan" has the responsibility to organize the awarding process in accordance with regulations; publicize the list of individuals proposed for awarding and the selection results on the media; complete the awarding dossier and submit it to the competent Council; consider and resolve recommendations related to the awarding process.

The awarding council works according to the principles of democracy, publicity, and secret voting.

Protect and promote the value of intangible cultural heritage

The Government issued Decree No. 39/2024/ND-CP stipulating measures to manage, protect and promote the values ​​of intangible cultural heritage in the UNESCO Lists and the National List of Intangible Cultural Heritage.

According to the Decree, the principle in managing, protecting and promoting the value of intangible cultural heritage is to ensure that intangible cultural heritage is practiced to guide people and communities towards good cultural values; preserve identity; aim for comprehensive social development; ensure community and social safety; protect the environment; ensure respect for cultural diversity, the role of the subject community and the specific characteristics of ethnic groups and regions. Intangible cultural heritage of different communities are equally respected.

Along with that, priority is given to protecting intangible cultural heritages at risk of being lost, heritages of ethnic communities living in mountainous areas, remote areas, border areas, islands, ethnic groups with difficulties, specific characteristics, heritages of value to the whole community and society; priority is given to the decision-making rights of the subject community for the long-term and continuous existence and practice of heritages, in accordance with the meaning and function of heritages, in accordance with the laws on cultural heritage of Vietnam and international documents to which Vietnam is a member.

Decree No. 39/2024/ND-CP takes effect from June 1, 2024.
