Policy "gaps"
Over the years, the private economic sector has contributed significantly to GDP, state budget revenue and created jobs for millions of workers. Resolution 41, approved by the Politburo in October 2023, is a breakthrough in affirming the important role of private enterprises in the country's development.
At the seminar "Improving the investment environment: Supporting Vietnamese enterprises" organized by the Industry and Trade Newspaper on September 19, Dr. Vo Tri Thanh - Economic expert assessed: "Resolution 41 is not only an orientation document but also a big step forward in creating a favorable environment for private enterprises; opening up opportunities for private enterprises to reach out to the world, becoming the main driving force of economic development" .

He also stressed that institutional reform, focusing on transparency and process simplification, is a decisive factor in realizing the goals of the Resolution.
According to the expert, institutional reform is not only about perfecting current regulations but also about building new, suitable regulations. There are many aspects to analyze about institutions, but Mr. Thanh mentioned three aspects, including "rules of the game", "players" and "way of playing".
In which, "rules of the game" are legal regulations that need to be improved and innovated to meet reality. "Players" and "ways of playing" are implementation methods and realization of reasonable values that need to be improved to bring benefits to businesses and the country. Therefore, there needs to be a testing environment for civil servants, helping them work effectively without being bound by personal interests and complicated administrative processes.

With 15 years of experience in the logistics sector, Mr. Hoang Dinh Kien - General Director of Hoa Phat Logistics Joint Stock Company said that the company has directly benefited from policies for private enterprises. The company's asset investment and revenue growth have increased 15 times.
However, Mr. Kien said that there are still difficulties in implementing administrative procedures. Although businesses fully comply with legal regulations, delays in processing procedures in some localities cause businesses to face many risks, affecting investment plans.
Mr. Kien gave an example from a client of the company; accordingly, this enterprise invested in a project in a locality, wanted to increase the investment capital from 3 million USD to 8 million USD but it took nearly 3 months to complete the procedures; while according to regulations, it only needed 15 days. The enterprise said that although it followed the law, the dedicated support from the state management agency was still not as expected.
"We expect the management agency to have a more supportive mindset for businesses. We do not ask for anything beyond the limit, just detailed and enthusiastic guidance so that businesses can implement immediately. If necessary, organize meetings and resolve problems promptly," Mr. Kien expressed.
To help businesses see the "light at the end of the tunnel"
Having worked for many years in the field of institutional and policy building, Mr. Phan Duc Hieu - Standing Member of the Economic Committee of the National Assembly also shared: "After contacting and dialogue with many businesses, they responded that: When a procedure has problems, maybe due to the fault of the business, maybe due to the fault of the state agency, they want it to be resolved, not to let the situation happen where there are problems but they do not know how, whether they will be resolved or not and whether they can be resolved or not... That greatly affects the spirit and motivation of the business ".

Therefore, the expert believes that if there are institutional problems to be solved, they must be promptly fixed. When problems arise that are not caused by the law but by the implementation process, businesses should report to local authorities and state agencies, so that those problems can be resolved and clarified.
"In practice, I have not seen any mechanism to resolve difficulties in the implementation stage. I really hope that when businesses encounter difficulties, there will be a hotline to report; report to be resolved, not to be recorded. There must be a mechanism to resolve difficulties arising in the production and business practices of businesses," said Mr. Phan Duc Hieu, emphasizing that "when businesses encounter difficulties, they see a "way out" which is a morale booster. But when they encounter difficulties and do not see a "way out", do not know when they will be resolved, and no one will resolve them, their spirit will easily be "dampened" a lot."

Sharing the same view, Lawyer Le Anh Van - Member of the Standing Committee of the Vietnam Association of Small and Medium Enterprises said that state agencies need to accelerate the reform of overlapping legal regulations, while providing stronger support to businesses in the digital transformation process. Along with that, business representative organizations need to be empowered and play a greater role in receiving and implementing public services that the State can transfer.
"This will help reduce the burden on the government apparatus, while also better supporting businesses in their operations. If these solutions are implemented, the business environment will become more favorable, helping businesses overcome difficulties and develop sustainably," Lawyer Le Anh Van affirmed.
