Some new regulations on medical practitioners

On January 9, 2023, at the 2nd extraordinary session, the draft Law on Medical Examination and Treatment (amended) was passed by the National Assembly. The Law on Medical Examination and Treatment (amended) aims to concretize the guidelines and policies of the Party and State, overcome limitations and shortcomings, and resolve newly arising issues to develop and improve the quality of medical services for people in the direction of fairness, quality, efficiency, development and international integration.

From January 1, 2024, the Law on Medical Examination and Treatment (amended) officially took effect, consisting of 12 chapters and 121 articles. The first principle of medical examination and treatment is to respect, protect, treat equally and not discriminate against patients.

Accordingly, some new regulations on medical practitioners according to the 2023 Law on Medical Examination and Treatment, specifically:

Expand the scope of practice based on the change from granting practice licenses based on professional qualifications to granting practice licenses based on professional titles.

Professional titles that must have a practice license include: Doctors, physicians, nurses, midwives, medical technicians, clinical nutritionists, outpatient emergency responders, clinical psychologists, traditional healers, people with traditional medicine recipes or traditional treatment methods.

Change the method of granting practice licenses from granting practice licenses through reviewing documents to requiring a professional capacity assessment before granting a practice license (not applicable to traditional medicine practitioners, people with traditional medicine recipes, and people with traditional treatment methods).

The law stipulates that a practice license is valid for five years and requires updating medical knowledge as one of the conditions for renewing a practice license.

At the same time, it is required that foreigners practicing long-term in Vietnam and examining and treating Vietnamese people must use Vietnamese fluently in medical examination and treatment, except in some cases of cooperation in exchanging experts, transferring techniques, and training.

In addition, the Law on Medical Examination and Treatment 2023 also adds a number of new regulations on medical examination and treatment facilities:

The Law on Medical Examination and Treatment (amended) officially takes effect from January 1, 2024.

Supplementing regulations requiring facilities to self-assess the quality of medical examination and treatment according to the basic quality standards issued by the Ministry of Health periodically every year and to update the self-assessment results to the Information System on management of medical examination and treatment activities to serve as a basis for inspection, assessment as well as public disclosure of information on the quality level of medical examination and treatment facilities.

Supplementing regulations on medical examination and treatment facilities to apply information technology with the aim of gradually connecting medical examination and treatment results between medical examination and treatment facilities.

Regarding enhancing people's access to medical examination and treatment services, the Law changes from 4 professional levels to 3 professional levels.

Allow private clinics in areas with especially difficult socio-economic conditions to organize beds for monitoring and treating patients, but not exceeding 72 hours.

In addition, 7 groups of subjects are given priority for medical examination and treatment, including: Patients in emergency situations, children under 6 years old, pregnant women, people with severe disabilities, people with severe disabilities, people aged 75 and over, and people with revolutionary contributions, in accordance with the characteristics of the medical examination and treatment facility .
