However, along with the benefits, artists also need to be responsible, setting their own principles when accepting to advertise for a product or service. In his correction, Chau Khai Phong said: "As an artist, I have always been very careful; when accepting an advertising contract, I have to review the content to know whether my story will affect the people around me or not, whether it is healthy or not." The male singer also admitted that this was his mistake, affirming that he will be more careful when working to avoid similar scandals.
Speaking to Thanh Nien , Lieutenant Colonel Do Minh Kim, Deputy Head of Department 3, Department of Cyber Security and High-Tech Crime Prevention (Ministry of Public Security), said that online gambling and betting are illegal acts, but this activity is being openly advertised on social networks. According to Mr. Kim, advertising activities aim to attract people to gamble online, potentially leading to illegal activities that affect security and order.
According to the law, football betting is an act that is strictly prohibited by law in all forms, and advertising is also prohibited according to Clause 1, Article 7 of the Advertising Law. Lieutenant Colonel Do Minh Kim analyzed that the above illegal online advertising still occurs partly due to the lack of management and supervision by authorities; thereby leading to the appearance of many videos and images advertising illegal activities, typically advertising gambling and football betting. Not to mention, posting such illegal advertising content is at risk of being exploited, propagandized, and sabotaged against the Party and the State. Therefore, Lieutenant Colonel Kim believes that celebrities, artists or anyone who receives advertising should learn about the product, because if they do not understand it clearly, it can cause unpredictable consequences.
Take initiative to protect yourself
Particularly in the case of Chau Khai Phong or Khanh Phuong, netizens raised the issue of needing strong, decisive action if the bad guys edit and edit clips for profit. Because this action greatly affects the reputation and honor of the artist, as evidenced by the strong reactions they have received from social network users. So what should we do to protect ourselves if our images are edited and edited for profit?
According to lawyer Nguyen Dang Tu (Ho Chi Minh City Bar Association), artists are famous and influential people. Therefore, when they notice their images being edited, they need to speak up to correct the information on social networks and mass media to alert everyone, and at the same time report the incident to the nearest police station to protect their rights.
Sharing the same view, lawyer Ha Thi Kim Lien (Phan Law Vietnam Law Firm) said that illegally exploiting, cutting, and editing artists' images to advertise illegal activities is a serious violation of an individual's personal rights, specifically the right to image protection as prescribed in Article 32 of the 2015 Civil Code. "This behavior not only violates the law but also directly affects the honor, reputation, and personal life of artists. Therefore, artists should proactively take strict measures to protect their legitimate rights and interests," lawyer Ha Thi Kim Lien responded.
Our ancestors have a saying "Buy a reputation for thirty thousand, sell a reputation for three coins", being caught up in scandals about gambling advertising causes artists to be turned away by the audience and face many other unpredictable consequences. Therefore, according to lawyer Ha Thi Kim Lien, when artists discover that their images have been edited for gambling advertising purposes, they need to take the initiative or authorize legal entities to contact the entity that used their image to request removal, remedy the consequences and compensate for damages.
"In case the violating unit does not take corrective action, the artist has the right to apply technological measures combined with legal measures, such as reporting, removing the violating clip on social networks, websites and reporting, sending a complaint to the authorities or filing a lawsuit in a competent court to request compensation for damages, forcing the other party to stop the violation and make a public apology," lawyer Ha Thi Kim Lien added.
