The Ministry of National Defense recently received a petition from voters in Hung Yen province requesting research to supplement the Military Service Law requiring "citizens of military age who pass the entrance exam to schools to have their results reserved but must complete their military service and then return to continue their studies."

The Ministry of National Defense said that the Law on Military Service (NVQS) 2015, after more than 8 years of implementation, has made important contributions to military and defense tasks, enhancing the combat strength of the Army, and firmly protecting the Fatherland.

Article 41 of the Law on Military Service stipulates that citizens studying at general education institutions or receiving regular university or college training during a training course of a training level will be temporarily deferred from military service.

On the other hand, to ensure social justice, the military service age of the above-mentioned deferred citizens is also extended so that citizens have the opportunity to fulfill their sacred duty to the Fatherland.

Therefore, Article 30 of the Law stipulates that citizens who are 18 years old or older can be called up for military service; the age for military service is from 18 to 25 years old; citizens who have received college or university degrees and have been temporarily deferred from military service can be called up for military service until 27 years old.

Article 50 of the Law stipulates the regime and policies for non-commissioned officers and soldiers serving in the army, discharged from the army and their relatives. Before joining the army, those who were studying or received a call to study at schools belonging to vocational education institutions or universities will have their results reserved and will be accepted to study at those schools.

The Ministry of National Defense believes that the above regulations contribute to ensuring fairness in the implementation of military service while meeting the legitimate aspirations of citizens regarding their rights and legal interests in studying and working.

At the same time, creating high-quality human resources necessary for the country's industrialization and modernization, while ensuring sufficient quantity and quality of citizens joining the army.

According to voters' recommendations, the requirement that "all citizens of military age who pass the entrance exams to schools have their results reserved but must complete military service and then return to continue studying" in the current period needs to be studied comprehensively, fully and thoroughly.

The Ministry of National Defense will continue to research and evaluate to report and propose to the Government to amend and supplement the Law on Military Service at the appropriate time when there is a sufficient political, legal, practical basis, ensuring scientific and feasible assurance.

The Ministry of National Defense said that Article 17 of the Law on Military Service clearly states that citizens who have registered for military service, when changing their place of residence or place of work or study, must go to the agency where they registered for military service to complete the procedures for transferring their military service registration. Within 10 working days from the date of moving to the new place of residence or place of work or study, they must go to the agency where they registered for military service to register for the transfer.

Citizens who have registered for military service and are called to study at schools belonging to vocational education institutions or universities in the national education system must go to the agency where they registered for military service to complete the procedures to transfer their military service registration to the educational institution.

After leaving school, one must complete the procedures to transfer military service registration to a new place of residence or workplace. The head of the educational institution is responsible for organizing the registration and transfer of military service registration for citizens.
