Is limiting the public disclosure of teachers' mistakes condoning it?

Báo Dân tríBáo Dân trí26/10/2024

(Dan Tri) - Every citizen has the right to denounce violations by organizations and individuals, but not in all cases is the denouncer right.

The Ministry of Education and Training is seeking opinions on the Draft Law on Teachers, which proposes not to make public information about teachers' violations until there is an official conclusion. This is a controversial content.

Compliant with multiple codes

According to lawyer - Dr. Dang Van Cuong, lecturer of Criminal Law, Thuy Loi University, the regulation on not disclosing information about teachers' violations when there is no official conclusion is consistent with the constitution and the law to protect personal privacy, protect the honor, dignity and reputation of teachers and is consistent with general principles of the law.

According to the provisions of the Constitution and laws of Vietnam, everyone is protected by law in terms of honor, dignity, reputation, personal rights, image rights and protection of personal privacy.

When handling petitions, complaints, denunciations, and crime reports, the competent authority must keep information confidential and comply with the principle of information confidentiality of the denouncer and the denounced.

Without specific regulations, many people take advantage of complaints, denunciations, and petitions to post on social networks or publicize on mass media information and images of others, which will clearly greatly affect the psychological life, health, and reputation of those involved.

According to the law, every citizen has the right to denounce and denounce violations of organizations and individuals according to the law.

However, not in all cases the accuser is right, and the content of the accusation is not well-founded. Especially with initial unverified information, information posted one-sidedly on social networks, there is no basis to determine whether it is true or false.

As technology develops, fake news, edited images, and products from artificial intelligence (AI) can create fake news and false information that affects the interests of organizations and individuals.

The content of the denunciation has not been verified and resolved by the authorities, has not had a final result, and is not controlled by regulations, but is freely posted on social networks or made public in the mass media, which may violate personal privacy, affect personal rights, image rights and honor and dignity of citizens, including teachers.

"In recent times, there have been many cases of unverified negative images and information about educational institutions and teachers being arbitrarily posted on social networks with negative, even malicious comments, seriously affecting the psychology and health of teachers.

When information is incomplete, creating negative public opinion can also negatively affect the process of resolving the case, especially negatively impacting the psychology of those involved," said lawyer Cuong.

According to this expert, the fact that the online community is always ready to "throw stones" and insult the honor, dignity and reputation of teachers when receiving incomplete information on social networks is a sad story, showing the serious degradation of social ethics and affecting the reputation of the education sector.

In particular, the regulation on not disclosing information about teachers' violations without an official conclusion from a competent authority is in accordance with the Constitution and laws, including the Law on Protection of State Secrets, the Civil Code, the Law on Cyber Security, the Law on Complaints, the Law on Denunciations and related legal documents.

Publicizing teachers' mistakes does not necessarily condone mistakes (Illustration photo).

Not necessarily condoning or abetting wrongdoing

Teaching is a noble profession, a profession respected by the whole society. Teachers violating discipline and the law are isolated cases, not a few cases that affect the reputation of an entire industry or field.

Therefore, according to Lawyer Cuong, protecting the reputation, honor, and dignity of teachers is protecting the honor, dignity, and reputation of teachers. This is consistent with the Vietnamese tradition of respecting teachers and valuing education. When teachers are not protected, social ethics will be overlooked, making it difficult to achieve respect, order, culture, and social stability.

"The regulation of not disclosing information about teachers' violations until there is an official conclusion is not to condone or assist teachers' violations, but to protect the confidentiality of information during the verification and settlement of complaints and denunciations, while also protecting personal rights, image rights, protecting personal privacy and reducing negative consequences.

Without a conclusion from a competent authority, all speculations, judgments, and attributions of public opinion can be wrong and cause negative impacts that are difficult to correct.

If teachers violate discipline, they must be held responsible before the law. Before the final conclusion has legal effect, they need to be protected, which is also protecting the reputation of the industry.

Once there is an official conclusion and it is determined to what extent the person has violated the law, they will be dealt with accordingly according to the law, without exception," lawyer Cuong affirmed.
