The revised Law on Petroleum and Law on Electricity, developed by the Ministry of Industry and Trade, contribute to overcoming practical bottlenecks to prevent waste of resources.
Identifying waste and bottlenecks in institutional and legal development
On November 9, 2022, the 6th Conference of the 13th Party Central Committee issued Resolution No. 27-NQ/TW on continuing to build and perfect the socialist rule-of-law state of Vietnam in the new period. The Resolution directed the building of a legal system that is democratic, fair, humane, complete, timely, synchronous, unified, public, transparent, stable, feasible, accessible, capable of regulating social relations, taking the legitimate and legal rights and interests of people, organizations, and enterprises as the center. At the same time, the Resolution also promotes innovation, promptly removes difficulties, and unleashes all potentials and resources to develop the country rapidly and sustainably.
On December 25, 2023, the Politburo issued Directive No. 27-CT/TW, identifying limitations in practicing thrift and combating waste. The Directive pointed out the lack of awareness, poor organization and lack of exemplary practice of thrift among some cadres, agencies and units. At the same time, advocacy and propaganda work has not received due attention.
In the article dated October 13, 2024, General Secretary To Lam deeply analyzed the issue of waste in law-making, pointing out that the quality of law-making has not met practical requirements, administrative procedures are cumbersome, and online public services are not convenient. The General Secretary frankly pointed out that institutions are the biggest bottleneck, hindering implementation and causing loss of resources. This is a factor that has not created a favorable environment to attract investment and development.

Guiding viewpoints on tasks and solutions to combat waste in institutional and legal building
From the Central Committee's directive documents such as Resolution No. 27-NQ/TW and Directive No. 27-CT/TW, many specific tasks and solutions on institution and law building have been proposed. General Secretary To Lam emphasized the need to change the thinking of law making, both ensuring state management and encouraging creativity. The General Secretary proposed reforming administrative procedures, evaluating the effectiveness of policy quality after promulgation, promoting decentralization and delegation of power with the motto that localities decide, do and take responsibility. All aim to minimize resource loss and create favorable conditions for people and businesses.
The Government has also issued many documents such as Resolution No. 98/NQ-CP dated June 26, 2024 and Decision No. 1764/QD-TTg dated 2023 to strengthen thrift practice and combat waste. These contents focus on amending and supplementing legal regulations to overcome conflicts and overlaps, and improve the efficiency of using state resources.
Ministry of Industry and Trade removes bottlenecks in building institutions and laws to combat waste
According to information from the Legal Department (Ministry of Industry and Trade), from January 1, 2021 to September 1, 2024, the Ministry of Industry and Trade has drafted and submitted for promulgation 156 legal documents, including 5 laws, 20 decrees, 4 decisions of the Prime Minister and 128 circulars. Notable laws are the 2022 Petroleum Law, the 2023 Consumer Rights Protection Law, and the 2024 revised Electricity Law. These laws not only institutionalize major policies of the Party and State but also overcome practical bottlenecks.
Typically, the 2022 Petroleum Law increases decentralization to the Ministry of Industry and Trade and the Vietnam Oil and Gas Group, facilitating oil and gas activities. Similarly, the 2023 Consumer Protection Law has expanded basic rights, protecting consumers in transactions in cyberspace. The revised 2024 Electricity Law has resolved bottlenecks in investment, construction of offshore wind power and emergency power projects, meeting the requirements of national energy security.
The Ministry of Industry and Trade has presided over, coordinated the development and advised the Government to submit to the National Assembly for initial comments the Draft Law on Chemicals (amended) at the 8th session of the 15th National Assembly. Based on the 4 major policies approved by the Government, the Draft Law identifies the guiding principle as "building laws in the direction of both ensuring state management requirements and encouraging creativity, liberating all productive forces, and unlocking all resources for development".
Regarding policy completion and implementation, in 2024, the Ministry of Industry and Trade submitted to the Government important decrees such as Decree No. 80/2024/ND-CP on the direct electricity purchase and sale mechanism, Decree No. 135/2024/ND-CP on encouraging the development of rooftop solar power. These policies not only promote the use of clean energy but also create the premise for a competitive electricity market in Vietnam. In addition, the plan to implement 4 national sectoral plans until 2050 has also been implemented synchronously and effectively by the Ministry of Industry and Trade.
To ensure the implementation of the revised Electricity Law, the Ministry of Industry and Trade has developed and issued a Plan for law enforcement, helping to disseminate and identify the responsibilities of relevant agencies. In particular, the Ministry has resolved difficulties for renewable energy projects, freeing up investment resources of up to 13 billion USD, overcoming the waste of social resources and contributing to promoting the supply of green and clean energy sources accounting for approximately 10% of the capacity of the entire national power system.
In addition, the Party Committee and the leadership of the Ministry of Industry and Trade have closely directed the legislative tasks according to the plan, focusing on reviewing the legal system, cutting unnecessary administrative procedures and handling conflicting and overlapping legal documents. The Ministry has also proactively reported and proposed new draft laws to remove difficulties, restore and develop the economy.
At the same time, Party committees and heads of units under the Ministry are responsible to the Party Executive Committee, the Minister, and leaders of the Ministry in the work of building institutions and laws; strictly implementing the spirit of "Investing in building and perfecting institutions is investing in development".
The Ministry of Industry and Trade also regularly holds meetings to carefully review draft laws and resolutions. The Ministry's leaders also focus on enhancing policy communication, helping people and businesses grasp and agree with major policies right from the drafting stage.
