Stop licensing the export and import of HFC substances

From January 1, 2024, the issuance of licenses for the export and import of HFC substances will be implemented according to the provisions of Decree No. 06/2022/ND-CP dated January 7, 2022 of the Government, the Import-Export Department, Ministry of Industry and Trade, said.

According to the Import-Export Department, on April 8, 2023, the Government issued Resolution No. 50/NQ-CP on the Government Conference with localities and the regular Government meeting in March 2023.

Therefore, the Government agrees with the proposal of the Ministry of Natural Resources and Environment and the Ministry of Industry and Trade to continue to manage the export and import of HFC substances according to the provisions of Circular No. 05/2020/TT-BCT dated March 16, 2020 of the Minister of Industry and Trade until December 31, 2023. Therefore, from January 1, 2024, it will comply with the provisions of Decree No. 06/2022/ND-CP dated January 7, 2022 of the Government regulating the reduction of greenhouse gas emissions and protection of the ozone layer.

Pursuant to Resolution No. 50/NQ-CP dated April 8, 2023 of the Government, the Import-Export Department shall issue licenses for the export and import of HFC substances to traders in accordance with the provisions of Circular No. 05/2020/TT-BCT until February 31, 2023.

From January 1, 2024, the issuance of licenses for the export and import of HFC substances shall comply with the provisions of Decree No. 06/2022/ND-CP dated January 7, 2022 of the Government.

According to Decree No. 06/2022/ND-CP, organizations engaged in the production, export, and import of controlled substances and equipment and products containing or manufactured from controlled substances.

At the same time, organizations that own equipment containing controlled substances and organizations that provide collection, recycling, reuse and treatment services for controlled substances as prescribed in Clause 1, Article 24 of the Decree are responsible for carrying out the first registration procedure before December 31, 2022 and reporting on the situation of using controlled substances to the Ministry of Natural Resources and Environment before January 15 every year.

In case of changes in registration information or registration of production and import quotas, the organization shall provide adjusted and supplemented information in the annual report.

Before HFC was invented, CFC (Chlorofluorocarbon) and HCFC (Hydrochlorofluorocarbon) were the most widely used refrigerants. However, the chemical composition of CFC and HCFC contains the element Chlorine and therefore these two substances cause the destruction of the ozone layer. And the birth of HFC is considered a great step forward in refrigeration technology.

HFC is an artificial refrigerant whose full name is Hydrofluorocarbon, made up of 3 elements: Hydrogen, Fluorine and Carbon. HFC has practical applications in many fields, such as: pharmaceuticals, food, refrigeration, fire fighting.

Although it does not destroy the ozone layer, studies have shown that HFCs have the potential to cause a greenhouse effect and global warming thousands of times higher than CO2./.
