Continuing the working program at the 8th Session of the 15th National Assembly, on the morning of November 9, Comrade Lai The Nguyen, Standing Deputy Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Thanh Hoa province chaired a discussion in groups, including 3 delegations: Thanh Hoa Provincial National Assembly Delegation, Ha Nam Provincial National Assembly Delegation and Tra Vinh Provincial National Assembly Delegation to discuss the draft Law on Teachers and the draft Law on Employment (amended).

Participating in giving opinions on the draft Law on Employment (amended), the National Assembly deputies highly agreed on the necessity of promulgating draft laws; at the same time, they gave opinions and added some contents to ensure that the law is built tightly and closely to reality to facilitate the implementation process when the law is promulgated and takes effect.

Participating in giving comments, National Assembly Deputy Dao Ngoc Dung (National Assembly Delegation of Thanh Hoa Province), Minister of Labor, War Invalids and Social Affairs, said: The proposal to develop a dossier to propose the Law on Employment (amended) stems from the requirement to institutionalize the 2013 Constitution, the Party's guidelines and policies and the State's policies on human resource development, job creation, labor market, and reform of unemployment insurance policies as stipulated in the Documents of the 13th National Congress of Delegates, Resolution 28-NQ/TW dated May 23, 2018 of the 12th Central Executive Committee on reforming social insurance policies, Resolution No. 42-NQ/TW dated November 24, 2023 of the 8th Conference of the 13th Central Executive Committee of the Party on continuing to innovate and improve the quality of social policies, meeting the requirements of national construction and defense in the new period and related Resolutions and Directives.

At the same time, the draft Law also ensures the consistency and synchronization of the legal system, especially for newly amended and supplemented Laws (Labor Code 2019, Law on Residence 2020, Law on Vietnamese Workers Working Abroad under Contracts 2020, Law on Social Insurance 2024...); consistent with standards, practices and commitments in the field of employment that Vietnam participates in such as: United Nations Convention on the Elimination of All Forms of Discrimination Against Women; Convention on the Rights of the Child, Convention on Persons with Disabilities, Conventions of the International Labor Organization and international commitments that Vietnam has participated in. Overcoming shortcomings and limitations in the provisions of the Law on Employment on job creation support, labor market information, employment services, vocational skills development and assessment, granting of vocational skills certificates, unemployment insurance, and labor registration. Responding to the requirements of improving capacity and effectiveness of State management in the field of employment, promptly responding and adapting in the context of population aging, industrial revolution 4.0, solving issues related to sustainable employment, and labor resource management.

Introducing the new contents of the draft Law on Employment (amended), National Assembly Deputy Dao Ngoc Dung said that the draft Law has institutionalized the goal of creating sustainable and quality employment, developing human resources and supporting the development of the labor market of the Documents of the 13th National Congress of the Party, Resolution No. 42-NQ/TW; the reform contents on unemployment insurance policy of Resolution No. 28-NQ/TW. Closely following the 4 groups of policies in the proposal to develop the Law project approved by the National Assembly in Resolution No. 89/2023/QH15. Synthesizing the recommendations of National Assembly deputies and voters on the field of employment; reviewing the limitations, obstacles and inadequacies arising in the summary of the implementation of the Law on Employment in 2013, assessing the current status of related social relations. Reviewing international treaties and commitments related to the field of employment.

Compared to the 2013 Law on Employment, the draft Law on Employment (amended) has a number of major amendments and supplements with 4 policy groups: Flexible, effective, modern, sustainable, integrated and focused labor market management; perfecting unemployment insurance policy as a tool for labor market management; developing vocational skills, improving the quality of human resources; promoting sustainable job creation.

It is necessary to stipulate the rights of teachers in and outside the public sector equally; it is necessary to classify the subjects with special priority in recruiting teachers at all levels of education, in which the criteria and standards must be determined...

National Assembly Deputy Tran Van Thuc (Thanh Hoa Province National Assembly Delegation), Provincial Party Committee Member, Director of the Department of Education and Training, pointed out the bottlenecks that the draft Law on Teachers has overcome and the inadequacies of related laws. At the same time, he proposed and recommended a number of issues, such as: It is recommended that the draft Law on Teachers should be researched and supplemented with regulations on the retention of a number of policies such as seniority allowances for teachers... for teachers transferred to work at educational management agencies, in order to ensure rights, recognize the process of dedication and encourage teachers with good professional qualifications to work at educational management agencies.

Reason: Educational management has a special nature, requiring educational managers to have professional qualifications that meet the requirements and must come from teaching, education or management practices at educational institutions. In practice, in the past, 100% of educational managers at Departments, Departments, and the Ministry of Education and Training were all core teachers at educational institutions. To ensure the rights, recognize the contributions of the teaching staff, and encourage good teachers to work at educational management agencies, it is necessary to supplement the above provisions in the draft Law on Teachers.

It is recommended to study, supplement, and create consensus among all levels and sectors to unify regulations on the Education Management Agency as the agency in charge of state management of teachers, in which the most important is the recruitment, use, appointment, and evaluation of the teaching staff; considering this the most important factor to help the education sector achieve the goal of ensuring a sufficient number of teachers, a uniform structure, and good professional qualifications, thereby improving the quality of education...

In his concluding remarks at the group, National Assembly Deputy Lai The Nguyen, Standing Deputy Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Thanh Hoa Province, said that the opinions of the National Assembly Deputies were in high agreement with the Government's Submissions to the National Assembly. The opinions were valid and derived from practical situations. This was the basis for the Drafting Committee to study, absorb and complete the draft Laws.
