From August 1, apartments that want to be ranked the highest (rank 1) must meet many conditions. This includes the requirement that investors must install and complete kitchen and air conditioning systems in each apartment.
Recently, the Government issued Decree 95/2024/ND-CP, detailing a number of articles of the Housing Law, effective from August 1, 2024.
Accordingly, Article 83 of the Decree classifies apartments into 3 categories based on 13 mandatory criteria. These criteria include location; facilities on the premises; parking; corridors, lobbies; elevators; electricity supply; apartments; management and operation services, etc.

For the apartment criteria (criterion 7), the apartment will be ranked highest when the investor installs and completes the air conditioning system and kitchen in the apartment. These are two criteria that do not appear in class 2 and class 3 apartments.
Sharing quickly with reporters of Investment Newspaper, Mr. Chien Nguyen (member of the SPE.R market research unit and also a broker), said that currently many high-end apartment projects in Da Nang are not equipped with basic equipment such as air conditioning, kitchen or hood.
“Many projects have apartments priced up to 70 million VND/m2, but when handed over, the house is completely empty. Meanwhile, many apartments priced at only 20 million VND/m2 have air conditioners and kitchens installed as standard for first-class apartments. Hopefully, when the decree is applied, the rights of home buyers will be more guaranteed,” Mr. Chien Nguyen shared a real story.
The only thing in common between all 3 apartment categories in the apartment criteria is that they must meet the ratio of the number of apartments with a usable area of less than 45 m2 compared to the total number of apartments.
In addition to the above criteria, class 1 apartments must also meet many other requirements that class 2 and class 3 do not have. For example, with the location criteria, the project must ensure distance to medical facilities, parks or entertainment areas.
With the criteria of on-site facilities, the highest-class apartments must have additional swimming pools and educational, medical or sports service areas. In addition, the projects must also arrange charging locations for electric vehicles and parking spaces in the basement, based on the criteria of parking space.
Or as with the digitalization and smart housing criteria, class 1 apartments will have to be equipped with smart lighting and water systems, along with 7 other accompanying requirements. On the contrary, for class 3 apartments, the project only needs to meet one criterion regarding the connectivity of the internet infrastructure.
