The Ministry of Education and Training (MOET) has just announced the draft Law on Teachers (3rd time) to collect public opinions. The project will be submitted to the National Assembly for consideration and initial comments at the 8th session (October 2024) and considered and approved at the 9th session (May 2025).
One of the notable contents in the draft law is prohibited acts against teachers and prohibited acts against other individuals and organizations.
According to Article 13 of the draft, the Ministry of Education and Training proposes to strictly prohibit teachers from engaging in the following acts:
Insulting the dignity, honor, and body of students, colleagues, and people;
Discrimination among learners in any form;
Cheating, intentionally falsifying results in enrollment, testing, examination, and student assessment activities;
Distorting educational content; taking advantage of teaching and educational activities to propagate content contrary to the Party's guidelines and viewpoints, the State's policies and laws, propagating hostile policies, causing division in the great national unity bloc;
Forcing students to participate in extra classes in any form, paying fees outside the provisions of the law;
Taking advantage of the title of teacher and teaching and educational activities to commit illegal acts; allowing others to use the teaching license in any form;
Quitting work without permission, participating in illegal strikes;
Violating teachers' ethics and other prohibited acts as prescribed by law.
In addition, to protect teachers, the Ministry of Education and Training also proposes prohibited behaviors for organizations and individuals:
It is strictly forbidden to insult the honor, dignity, or violate the body of teachers;
Obstructing the professional activities of teachers;
Assigning teachers not in accordance with the agreement and commitment in the teaching contract;
Discrimination among teachers in any form;
Paying salaries not in accordance with the contract; not fully and promptly implementing the teacher's regime and policies as prescribed;
Disclose information about teachers' violations when there is no official conclusion from a competent authority during the process of considering discipline or prosecuting the teacher's legal responsibility and in cases where the violations are not serious enough to require revocation of the teaching license.
In addition to the above proposals, the Ministry of Education and Training also proposed many new regulations in the Draft Law on Teachers such as: Preschool teachers and teachers of schools for children with disabilities are allowed to retire 5 years earlier than the regulations; teachers still receive seniority allowances, preferential allowances and are ranked at the highest salary in the administrative career salary scale. Teachers working in difficult areas and young teachers are supported with housing, training and development in some cases...
