Presenting the report on the draft Law amending and supplementing a number of articles of the Law on Guards, Deputy Minister of Public Security Le Quoc Hung said that on March 16, 2022, the Politburo issued Resolution No. 12-NQ/TW on promoting the building of a truly clean, strong, disciplined, elite, and modern People's Public Security force; on May 25, 2022, the Central Public Security Party Committee issued Plan No. 118-KH/DUCA on implementing Resolution No. 12-NQ/TW of the Politburo; to implement this, the Ministry of Public Security issued Project No. 04/DA-BCA dated January 30, 2023 of the Ministry of Public Security on "Building a truly clean, strong, disciplined, elite, and modern Guard force"; at the same time, to meet the requirements of the tasks in the new situation, the task is to build a Guard force that advances straight to modernity by 2025. Therefore, it is necessary to perfect the regulations of the Law on Security Guards on forces, tasks, powers and responsibilities to promptly meet the above tasks.
Conclusion No. 35-KL/TW dated May 5, 2022 of the Politburo on the list of leadership positions and equivalent positions of the political system from the central to grassroots levels; in which a number of high-level positions and positions such as Standing Member of the Secretariat, Chief Justice of the Supreme People's Court, and Chief Prosecutor of the Supreme People's Procuracy are added to the group of high-level leadership positions of the Party, State and Vietnam Fatherland Front. However, the 2017 Law on Guards has not yet stipulated that these people are subjects of guarding.

Conclusion No. 35-KL/TW dated May 5, 2022 of the Politburo on the list of leadership positions and equivalent positions of the political system from the central to grassroots levels; in which a number of high-level positions and titles such as Standing Member of the Secretariat, Chief Justice of the Supreme People's Court, and Chief Prosecutor of the Supreme People's Procuracy are added to the group of high-level leadership positions of the Party, State and Vietnam Fatherland Front. However, the 2017 Law on Guards has not yet defined these people as subjects of guarding. In order to specify the provisions in Clause 2, Article 14 of the 2013 Constitution and stemming from the shortcomings arising in the implementation process, amending and supplementing a number of provisions of the Law on Guards is really necessary to promptly amend and supplement inappropriate provisions, overcome shortcomings of the legal system and meet practical requirements for guarding work.
Mr. Hung also informed about the amendment and supplement to Article 10. Specifically, First, adding the subject of protection as human beings, including: Standing member of the Secretariat, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy.
Second, rectify and arrange the order of key leadership positions and titles of the Party and State.
Third, clearly define the criteria for determining the objects of protection as especially important events; specifically, amend in the direction of narrowing the scope of objects of protection as especially important events. Specifically: Amend and supplement the Law on Security Guards in the direction of stipulating: "Conferences and festivals organized by the Central Committee of the Communist Party of Vietnam, the President, the National Assembly, and the Government with the objects of protection specified in Points a, b, c, d, Clause 1 of this Article in attendance; national congresses organized by socio-political organizations at the Central level; international conferences organized in Vietnam with the objects of protection specified in Points a, b, c, d, Clause 1 and Point a, Clause 2 of this Article in attendance" (with the objects of protection being key leaders: General Secretary, President, Chairman of the National Assembly, Prime Minister, and international guests with equivalent positions) are determined to be especially important events.
Examining the above issue, related to the addition of the guard subjects to the Standing Committee of the Secretariat, the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, and Chairman of the National Assembly's Committee for National Defense and Security, Le Tan Toi, said that according to Conclusion No. 35-KL/TW on the list of titles, leadership positions and equivalents of the political system from the Central to the grassroots level, it has identified senior leaders of the Party, State and Vietnam Fatherland Front as: Standing Committee of the Secretariat, Politburo member, Secretariat member, Chairman of the Vietnam Fatherland Front Central Committee, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, Vice President, Deputy Prime Minister, and Vice Chairman of the National Assembly. Meanwhile, the titles and positions of Politburo member, Secretary of the Party Central Committee, Chairman of the Vietnam Fatherland Front Central Committee, Vice President, Deputy Prime Minister, and Vice Chairman of the National Assembly have been stipulated in the Law on Guards as guard subjects.
Therefore, the Standing Committee of the National Defense and Security Committee agreed to add the Standing Secretary of the Secretariat, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy to the security guard group in order to promptly institutionalize the Party's regulations and ensure consistency, fairness, and transparency in terms of titles, positions, and regimes and policies for senior leaders of the Party, State, and Vietnam Fatherland Front. The addition of the three above-mentioned titles and positions is consistent with the nature and importance of these positions in the political system.
