Dak Lak: National target programs face difficulties due to... lack of capital

On the afternoon of April 11, the National Assembly Delegation of Dak Lak province had a working session with the Standing Committee of the People's Council, People's Committee, Vietnam Fatherland Front Committee of the province and representatives of leaders of departments, branches and sectors to prepare the content to participate in the 9th Session of the 15th National Assembly.

According to the report at the working session, in recent times, Dak Lak province has actively implemented the resolutions of the National Assembly and the Government on socio-economic development, ensuring national defense - security and social security. However, the implementation of the National Target Programs (NTPs), especially the Socio-Economic Development Program for Ethnic Minorities and Mountainous Areas (2021 - 2030), is facing many obstacles.

Deputy Director of the Department of Finance of Dak Lak province, Nguyen Tan Thanh, said that in the period of 2021 - 2025, the locality was assigned by the Prime Minister a total capital of about 2,052 billion VND to implement the program. Up to now, the province has only been allocated nearly 1,863 billion VND, reaching about 91% of the plan, still lacking about 189 billion VND. Notably, up to this point, the locality has not been assigned the budget for public service expenses and preferential credit capital targets for 2025 according to Decree 28/2022/ND-CP of the Government. This causes difficulties in developing plans and arranging counterpart funds to synchronously implement the program contents.

“In the previous two years, the Central Government allocated capital quite promptly, but there has been no announcement for 2025. The delay in capital allocation has made localities passive in arranging and balancing the budget and unable to start the program implementation plan early,” the Deputy Director of the Department of Finance stated.

Also at the meeting, many delegates pointed out shortcomings in policy implementation, especially legal regulations related to organizational structure and administrative management. Delegates reflected on the situation that some laws such as the Law on People's Courts, the Law on Civil Judgment Enforcement, the Land Law, etc., when implemented in practice, still face confusion due to untimely and inconsistent guidance, causing difficulties for the grassroots and affecting the rights of people and businesses.

Deputy Chief Justice of the Dak Lak Provincial People's Court Trinh Van Toan stated that in reality, most of the current administrative cases are related to local development projects, in which the defendants are mainly district-level People's Committees. However, due to the process of arranging and merging administrative units, many district-level People's Committees do not send representatives to participate in the proceedings, do not provide documents and evidence as prescribed, causing difficulties for the trial process.

“The district-level People’s Committee may no longer operate in the near future, so who will be the successor to participate in the litigation? This is a very complicated issue and needs specific guidance,” Mr. Toan suggested.

Regarding the fields of agriculture and environment, delegates reflected on the overlapping and inconsistency between the Forestry Law and the Land Law, especially in the regulations related to forest leasing, forest valuation and approval authority. Many procedures such as signing forest leasing contracts, determining the price of standing trees, organizing forest leasing auctions, etc. have not been implemented yet due to the lack of guiding documents. Some difficulties were also raised in terminating housing development project contracts, investment approval procedures, as well as credit policies for production development in ethnic minority areas.

Speaking at the conference, Deputy Head of the Provincial National Assembly Delegation Nguyen Thi Thu Nguyet acknowledged and shared the difficulties of the locality. The opinions of the delegates at the conference will be compiled by the Provincial National Assembly Delegation and forwarded to departments, branches, units, and competent authorities for consideration and resolution; and at the same time, it will be reported to the National Assembly and central ministries and branches in the next session. Thereby, promptly removing obstacles in resource allocation and organizing the implementation of national target programs, contributing to ensuring the effectiveness of public investment and social security in the area.
