On October 15 in Hanoi, the Vietnam Real Estate Association coordinated with the Ministry of Natural Resources and Environment and the Ministry of Construction to organize a Dialogue Conference between law drafting agencies, experts, businesses and the press on how to understand and apply the Land Law, Housing Law, Real Estate Business Law and guiding documents to the practical operations of real estate businesses.

Pursuant to Official Dispatch No. 79/CD-TTg dated August 13, 2024 of the Prime Minister on effectively organizing the implementation of the Land Law, Housing Law, and Real Estate Business Law; implementing the opinions of leaders of relevant ministries and branches; through surveying the actual operations and needs of the real estate business community; the Vietnam Real Estate Association has a plan to implement the Communication Project to propagate, disseminate, and effectively implement policies and laws on land, housing, and real estate business.
The project includes a series of activities organized by the Vietnam Real Estate Association in coordination with the Ministry of Natural Resources and Environment and the Ministry of Construction under the direction of Deputy Prime Minister Tran Hong Ha in Official Dispatch No. 7058/VPCP-NN.

The first event of the program series is the Dialogue Conference between law drafting agencies, experts, businesses and the press on how to understand and apply the Land Law 2024, Housing Law 2023, Real Estate Business Law 2023 and guiding documents to the practical operations of real estate businesses.
The objective of the Communication Project, including the Dialogue Conference, is to disseminate new points and important issues that people and businesses need to pay attention to in the 3 new laws and implementing guidelines to understand correctly and fully, aiming to apply and implement synchronously and effectively. In addition, the Conference provides space to listen to the opinions and recommendations of businesses, thereby answering questions that still cause concerns or problems that have arisen and may arise in the practice of applying the new legal framework on land, housing, and real estate business for people and businesses. At the same time, clarify the impacts of the new law on the operations and investment and business environment of real estate businesses, including opportunities and risks, thereby making appropriate recommendations for businesses; Provide recommendations and propose solutions to contribute to improving legal policies on land, housing, and real estate business, aiming to create a favorable business environment for enterprises.

The conference was divided into two sessions. The morning session had the topic: Effective application of the 2024 Land Law and its implementing documents into the practical operations of real estate enterprises. Accordingly, the conference listened to presentations from representatives of the Ministry of Natural Resources and Environment, the National Assembly's Economic Committee and experts on: Notable new points of the 2024 Land Law and its implementing documents; Correctly understanding and effectively implementing the 2024 Land Law and opportunities for real estate enterprises; Points to note in the process of guiding, applying and implementing the 2024 Land Law by localities and real estate enterprises, especially for issues that have many interpretations. In addition, the conference focused on clarifying "hot" issues related to: Land and project planning; Project auction and bidding; Land valuation methods, land price lists; Determining specific land prices for cases of land allocation and lease before the 2024 Land Law; transitional regulations; impacts on real estate businesses, real estate prices when applying the new land price calculation method...; and other issues that need to continue to be specified correctly and fully in detailed regulations and implementation instructions.

The afternoon session had the topic: Implementation of the Housing Law 2023, the Real Estate Business Law 2023: Opportunities, challenges and issues to note for localities and real estate enterprises. Here, the Conference listened to the presentation of the Representative of the Ministry of Construction on: New points affecting real estate enterprises of the Real Estate Business Law, the Housing Law 2023 and detailed regulations and the presentation of experts on: Points to note in the process of guiding, applying and implementing the Housing Law, the Real Estate Business Law of localities and real estate enterprises.
At the same time, in the discussion section, representatives of the drafting agency and experts will focus on discussing, clarifying and answering concerns of enterprises related to: Capital mobilization from housing business, future construction works; transfer of real estate business contracts; guarantee of financial obligations of investors in future real estate business in cases where the buyer does not request a guarantee; legal basis for investment and business of condotel and officetel products; social housing, renovation of old apartments, housing standards and regulations...; and other outstanding issues that need to continue to be specified correctly and fully in detailed regulations and implementation instructions to improve the effectiveness of implementation in practice and facilitate investment and business activities of enterprises.

After the Dialogue Conference, the Vietnam Real Estate Association will report to the Prime Minister on recommendations and proposals to contribute to improving law enforcement, effectively bringing new policies and laws on land, housing and real estate business into life, promoting healthy and sustainable market development, while protecting the legitimate rights and interests of people and businesses./.
