According to the Inspectorate of Bac Ninh province, in 2013, Dong Chue village (now Dong Chue quarter) organized the unauthorized allocation of land in Cua Dinh area (Cau Gao), a total of 21 lots, with an area of ​​2,669 square meters.

Before organizing the bidding, the Party Cell and the Dong Chue Village Leadership discussed and agreed to bid for land to households and individuals to create capital for the construction of concrete roads. All proceeds from the land bidding will be kept in the village fund for management and use to repay debts for land consolidation, construction of concrete roads in the village, construction of the village communal house and some other contents. The total amount collected is more than 6 billion VND.

In 2014, implementing the direction of the People's Committee of Que Vo district (now Que Vo town), the People's Committee of Nhan Hoa commune (now Nhan Hoa ward) deployed the work of considering land allocation and granting land use right certificates (LURCs) according to inter-sectoral guidance No. 04. During the implementation process, Dong Chue village and 16 households that won the bid to buy land from the village in Cua Dinh area prepared documents to apply for land allocation and granting of LURCs. In order for 17 plots of land to be eligible for land allocation and granting of LURCs, the Dong Chue village leadership re-prepared the documents, postponed the time of making the payment receipt and land allocation minutes from July 2013 to September 2012. Households who wrote applications for land allocation and granting of LURCs postponed the time of land purchase from July 2013 to September 2012.

Regarding the unauthorized land allocation, the Inspectorate of Bac Ninh province pointed out that the Party cell and the leadership of Dong Chue village (period 2011 - 2014) were responsible for the fact that in 2013, the Party cell and the leadership of Dong Chue village discussed, agreed and issued policies, resolutions directing and establishing a Capital Creation Committee to organize the unauthorized land allocation in Cua Dinh area, a total of 21 lots, to 16 households and individuals to create capital for the construction of concrete roads.

The inspection agency also determined that the People's Committee of Nhan Hoa commune (term 2010 - 2015) was responsible for lax land management in the locality and did not take timely measures to prevent and handle the case, allowing Dong Chue village to illegally allocate land in 2013.

Regarding the consideration of land allocation and issuance of land use right certificates according to inter-sectoral guidance No. 04, the inspection agency determined that the Department of Natural Resources and Environment of Que Vo district, the Office of Land Use Right Registration of Que Vo district and specialized staff appraising land allocation application files, issuing land use right certificates... are responsible for the lack of responsibility in appraising land allocation files, issuing land use right certificates for 17 plots of land in Cua Dinh area...

According to the Inspectorate, the Inspection Team of the Que Vo District Party Committee's Inspection Commission is responsible for pointing out the existing problems and violations regarding land and the issuance of land use right certificates that occurred in Dong Chue village, but has only recommended administrative handling. The Inspection Team of the Que Vo District People's Committee is responsible for not recommending handling the collective and individual responsibilities of the district's departments, offices, and professional agencies in considering land allocation and issuing land use right certificates according to inter-sectoral guidance 04, for the existing problems and violations.

In addition, the People's Committee of Que Vo district (2013 - 2021 period) is responsible for signing Decision 1315 dated June 30, 2014 on land allocation and granting of land use right certificates for 17 plots of land of households that are not eligible for land allocation and granting of land use right certificates according to inter-sectoral guidance No. 04. Signing 14 land use right certificates before the households have fulfilled their financial obligations is not in accordance with regulations.

Based on the inspection results and consultation with relevant authorities, the Chief Inspector of Bac Ninh province transferred the case file of "Land allocation without proper authority in violation of Article 15 and Article 37 of the 2003 Land Law and re-establishment of land allocation application and issuance of land use right certificates in violation of the provisions of inter-sectoral guidance No. 04, of Dong Chue village, Nhan Hoa commune" to Que Vo town police for consideration and handling in accordance with the provisions of law.
