Hoi An City People's Committee requests Quang Nam Provincial People's Committee and the Department of Natural Resources and Environment to consider and allow Hoi An City People's Committee to consider allocating residential land, with land use fees collected without auction, for the above cases according to the procedures prescribed by the 2013 Land Law and related implementing documents.

Mr. Nguyen Minh Ly, Vice Chairman of Hoi An City People's Committee, has just signed a document to send to Quang Nam Provincial People's Committee to request the policy to resolve the issue of land allocation with land use fees collected without auction for cases in Thanh Nhut Village Resettlement Area, Cam Thanh Commune.

Accordingly, Hoi An City People's Committee said that recently, the issue of land allocation for 41 households in Thanh Nhut Village Resettlement Area (old village 3), Cam Thanh Commune has been repeatedly proposed by Hoi An City People's Committee and has been directed and guided by the Provincial People's Committee and departments and branches to resolve.

Hoi An City People's Committee has assigned the city's specialized departments and Cam Thanh Commune People's Committee to carefully review the list of cases considered for land allocation to ensure land allocation to the right subjects, in accordance with the provisions of law.

However, during the implementation process, Hoi An City People's Committee encountered difficulties related to the procedures for land allocation for the above cases if referring to Point c, Clause 3, Article 124 of the 2024 Land Law and Clause 4, Article 153 of Decree 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law.

Based on the above regulations, the Provincial People's Committee shall, based on the actual situation of the locality, issue conditions, procedures and appraisal procedures for land allocation without auction of land use rights to individuals. Therefore, while waiting for the Provincial People's Committee to issue the above regulations; at the same time, realizing that these are complicated cases, pending before the 2024 Land Law takes effect, the Hoi An City People's Committee requests the Quang Nam Provincial People's Committee and the Department of Natural Resources and Environment to consider and allow the Hoi An City People's Committee to consider allocating residential land, with land use fees collected without auction for the above cases according to the procedures and regulations of the 2013 Land Law and related implementing documents.

The Office of the People's Committee of Quang Nam province has just forwarded the above document to the Department of Natural Resources and Environment to preside over and coordinate with the Department of Finance and related sectors to study and advise on resolving the request of the People's Committee of Hoi An city according to authority and regulations.
