Along with the rapid urbanization process, the demand for construction of technical infrastructure and social infrastructure is increasing. Every year, the total investment in construction of the whole society accounts for about 30% of GDP. Overall, the quality of construction works is constantly improving.
The completed projects have been effective when put into operation, creating a new look for the country and are proud achievements of the country's renovation. However, there are still projects of poor quality that do not meet the conditions for acceptance or are under construction or have just been put into operation and have had incidents, causing serious damage to people and property.
It can be affirmed that the quality of construction works has a direct relationship with the national economy, the rapid, healthy and sustainable development of the national economy, and the safety of people's lives and property. Based on the objective laws of the market economy, to ensure the quality of construction works and community safety, protect lives and property, and ensure the sustainable development of the country... Therefore, the capacity to supervise and manage construction investment activities occupies a top priority.
According to urban planning expert, master, architect Tran Tuan Anh, in the current period, the construction industry has a lot of development potential, first of all, the rapid urbanization speed has increased the demand for housing and infrastructure (housing, commercial centers, transportation, industrial parks, tourist areas, satellite cities...), along with the need to renovate and upgrade the infrastructure system in use. Meanwhile, with the trend of green construction and sustainable development, it brings opportunities for the construction industry to apply and develop technology with many new methods, friendly to the environment.
However, construction activities are facing many challenges: economic recession affects the growth rate of the industry; lack of high-quality human resources for construction and management leads to poor quality of works; licensing and construction planning activities are still weak; problems and inadequacies in the legal system cause delays and increase investment costs; at the same time, the response capacity of the infrastructure system in the process of socio-economic development also causes challenges for the construction industry.
“The most important issue now is to soon complete the policy system to create conditions and maximize the capacity of the construction industry, contributing more to the process of socio-economic development; the State needs to focus on investing in technology research to apply to the implementation and management of the construction industry; focus on training high-quality human resources to improve work efficiency, construction quality and State management. At the same time, it is necessary to tighten sanctions for violations in construction activities for individuals, organizations and civil servants,” said Mr. Tran Tuan Anh.
Flexible application of solutions
Currently, many countries in the world have a very strict construction management system, which contributes significantly to ensuring the quality of construction works as well as preventing construction violations. For example, in China, a construction quality management system has been established in construction activities since the 1980s; the state issues standards and regulations on design, construction, and quality certification for construction units and requires all constructions to comply with them, and constructions can only be used after completing the acceptance procedures; the person in charge of the supervision unit is not allowed to concurrently work in a state agency.
Similarly, in Singapore, the implementation of construction projects must meet the requirements of construction planning, safety, fire prevention and fighting, traffic, and environment to be approved by the construction management agency. In particular, supervisors operate independently without working in any agency or organization, they work based on honor, reputation, and experience.
Or in Japan, a system of legal documents has been established that strictly regulates the management of construction investment activities, with a series of laws, but with close synchronization and unity with each other, such as the Law on Promoting Bidding and Legal Contracts for Public Works, the Law on Public Finance, the Law on Promoting Quality Assurance of Public Works... Technical standards for inspection will be compiled by the Regional Development Bureaus, and the inspection content in the supervision work will be directly carried out by state officials.
According to Master Ninh Viet Dinh - Arbitrator of the Vietnam International Arbitration Center (VIAC), besides the results achieved in the recent past in State management of construction investment activities, there are still many limitations, causing loss and waste of investment capital from the State budget. Many legal documents overlap, contradict each other, and have local content; there is no professional guidance system, while the national database system lacks unity and science...
Construction investment is an important driving force of socio-economic development and the State management of construction activities is to carry out a task most effectively with existing resources in the shortest time, in order to stimulate production development, reduce unemployment and improve people's quality of life. Therefore, with the role of market orientation, the State needs to promote the capacity of participating entities in a healthy, transparent, fair direction... creating a favorable environment for construction investment activities to strictly comply with the law.

“Currently, Vietnam is in the process of deep international integration, so ensuring compliance with international practices in the current period is important, so referring to international experiences to apply and draw lessons is necessary. However, the quality of “localization” of international documents and management models is still low, so we need to be more flexible in applying international solutions and experiences in the management of construction investment activities” - Master Ninh Viet Dinh said.
Regarding solutions to overcome violations in construction activities, urban planning expert Tran Tuan Anh said that the State needs to consider and further promote the process of decentralization and delegation of power to localities down to the commune level (according to the model of the Urban Construction Management Team in Hanoi); in parallel with perfecting legal regulations related to administrative handling of violations in construction...
“The State needs to study, supplement and provide specific guidance on standards and regulations in construction activities; overcome the overlapping, conflicting and inconsistent situations between legal documents; strengthen propaganda and dissemination of legal knowledge related to construction. At the same time, there needs to be closer coordination between law enforcement agencies in State management of construction; but most importantly, it is necessary to prevent negativity, with stricter sanctions to eliminate the “ask-give” mechanism, which leads to violations,” said Mr. Tran Tuan Anh.
