Officially abolish 11 legal documents in the field of education

Eleven circulars and decisions in the education sector will be officially abolished from 2025, including regulations on guidelines for managing education and training budgets, standards for 5-year-old children's development, and pedagogical training programs for lecturers in higher education institutions...

The Ministry of Education and Training has just issued a Circular to abolish a number of legal documents in the field of education .

Accordingly, after the Ministry of Education and Training agreed with the Ministry of Finance, Ministry of Health, Ministry of Home Affairs, Ministry of Labor, Invalids and Social Affairs and the Ethnic Committee, 11 circulars and decisions were officially abolished from January 14, 2025.

The documents in the field of education that are abolished include:

Joint Circular dated April 21, 1994 of the Ministry of Education and Training and the Ministry of Finance guiding the management of education and training budget.

According to this circular, the Ministry of Education and Training will proactively coordinate with the Ministry of Finance and the State Planning Commission in developing, synthesizing and planning the allocation of the entire sector's budget. The Ministry of Finance and the State Planning Commission, based on the proposals of the Ministry of Education and Training, will review and balance the budget and submit it to the Government for submission to the National Assembly for approval.

University lecturers no longer have to study for a teaching certificate, but instead study a training program according to the professional title standards of university lecturers.

Currently, the documents basing on the issuance of Joint Circular No. 35 have been replaced by the provisions of the 2015 State Budget Law and the provisions of the 2019 Education Law .

Joint Circular dated March 16, 1999 of the Ministry of Education and Training, Ministry of Finance, Ministry of Health guiding the implementation of medical service regime for foreign students studying in Vietnam.

Accordingly, foreign students, postgraduates , and interns studying at Vietnamese schools that are subject to agreements or not subject to agreements but have been approved by the Vietnamese Government before studying in Vietnam, during their study period in Vietnam, are entitled to free medical services according to the provisions of this Circular.

However, some provisions of the circular are no longer consistent with the Law on Health Insurance (amended and supplemented in 2014). The Law on Health Insurance stipulates that foreigners studying in Vietnam who are granted scholarships from the Vietnamese state budget are subject to health insurance paid by the state budget and have their medical examination and treatment costs paid by the health insurance fund within the scope of benefits, with a benefit level of 80% of the medical examination and treatment costs.

Circular dated July 22, 2010 of the Ministry of Education and Training promulgating Regulations on the set of development standards for 5-year-old children. The set of development standards for 5-year-old children includes 4 areas, 28 standards, 120 indicators, which is the basis for specifying the goals, content of care, education, selection and adjustment of care and education activities to suit 5-year-old preschool children.

The Ministry of Education and Training explained that the abolition of this circular was because in recent years, the implementation of Circular 23 has basically met the purpose of supporting the implementation of the preschool education program for 5-year-old children.

Through inspection, monitoring and reporting by localities, the simultaneous implementation of two documents (a circular promulgating the preschool education program and a circular promulgating the set of standards) causes difficulties for preschool education facilities (easily generating records and books), while the content of the set of standards has been transformed into the preschool education program.

Circular dated May 30, 2011 of the Ministry of Education and Training promulgating Regulations on science and technology activities in higher education institutions, including development orientation and science and technology plans; implementation of science and technology plans; management of science and technology activities; rewards and handling of violations.

Accordingly, the Law on Higher Education was amended in 2018 to stipulate that “The Government shall regulate scientific and technological activities in higher education institutions”. Currently, the content of Circular No. 22 has been included in Decree No. 109/2022 of the Government regulating scientific and technological activities in higher education institutions.

Circular dated April 12, 2013 of the Ministry of Education and Training promulgating the Pedagogical Training Program for lecturers in higher education institutions , for those who have graduated from university or higher, have not undergone pedagogical training and wish to become lecturers in higher education institutions. The goal is to supplement human resources and improve the pedagogical capacity of the teaching staff, meeting the requirements of education in the context of industrialization, modernization of the country and international integration.

Up to now, the issue of pedagogical training has been regulated in the Decision promulgating the training program according to the professional title standards of university lecturers issued in 2022.

Accordingly, the training subjects are teaching staff currently working at public university educational institutions and working in positions suitable to the responsibilities and tasks of the professional title of university lecturer , or individuals in need of training and certification of training, according to the standards of the professional title of university lecturer .

In addition, there are circulars on regulations on standards for the titles of directors and deputy directors of the Department of Education and Training under the People's Committees of provinces and centrally-run cities; professional training programs on inclusive education management; Khmer language programs in primary schools...
