Implementing the Prime Minister's Official Dispatch on timely rectification of land use rights auctions and to continue to improve the effectiveness and efficiency of land use rights auctions, contributing to the healthy real estate market, improving the investment and business environment, promoting socio-economic development, the People's Committee of Thanh Hoa province has just issued Official Dispatch No. 52/UBND-KTTC to rectify land use rights auctions in the province.

Accordingly, the Provincial People's Committee requests the Department of Justice, Department of Natural Resources and Environment, Department of Finance, Department of Construction, Provincial Police, Provincial Land Fund Development Center, People's Committees of districts, towns and cities to continue to thoroughly grasp and strictly implement Official Dispatch No. 82/CD-TTg dated August 21, 2024 of the Prime Minister, the direction of the Chairman of the Provincial People's Committee in Official Dispatch No. 12498/UBND-KTTC dated August 26, 2024 and the direction of the Prime Minister in Section 1 of Official Dispatch No. 134/CD-TTg dated December 14, 2024 on rectifying the auction of land use rights.
The People's Committees of districts, towns, cities, and the Thanh Hoa Land Fund Development Center, according to their assigned functions and tasks, shall self-review the organization of land use rights auctions for projects, ensuring that the auctions are in accordance with the law, public, and transparent; promptly detect and prevent acts of taking advantage of land use rights auctions for profit, causing market disruption, or strictly handle violations of the law in land use rights auctions, in accordance with the direction of the Prime Minister in the above-mentioned Official Dispatch; report to the Chairman of the Provincial People's Committee on the implementation results before January 20, 2025.
Specifically, the above-mentioned units need to focus on performing well a number of tasks, such as: Organizing the public disclosure of planning, land use plans, construction planning, urban planning in the area where land use rights auctions are held and neighboring areas; taking measures to ensure the supply of residential real estate and residential land suitable to the accessibility and payment capabilities of the majority of people in need, overcoming the imbalance between supply and demand in the real estate market.
Before determining the starting price according to the land price list for the auction of land use rights, it is necessary to review and propose to the competent authority to adjust and supplement the corresponding land price in the land price list in the area and location of the auction according to the provisions of the law on land, ensuring that the starting price put up for auction must be consistent with the conditions of the invested infrastructure and the actual land price level in the auction area.
The construction of land use rights auction plans must be strict, scientific, and under the control of competent authorities when constructing auction plans, avoiding the situation of taking advantage of auctions for personal gain, causing market disruption; directing the unit assigned to organize land use rights auctions to choose appropriate auction forms and methods to limit collusion, price suppression or price inflation.
Review local land demand, plan and invest in infrastructure construction of land plots expected to be auctioned for land use rights; at the same time, consider arranging suitable land funds to implement resettlement land allocation, land allocation without land use rights auction for subjects specified in points a, b, c and d, Clause 3, Article 124 of the 2024 Land Law and relevant legal provisions...
The People's Committee assigned the Department of Justice to preside over and coordinate with the Department of Natural Resources and Environment, the Department of Finance, the Department of Construction and related units to promptly and fully implement the direction in Section 2 of Official Dispatch 134/CD-TTg of the Prime Minister; at the same time, continue to monitor and review new legal documents issued by the Government, Ministries and Central branches to disseminate and guide the People's Committees of districts, towns and cities, Thanh Hoa Land Fund Development Center to conduct land use rights auctions to ensure compliance with legal provisions or advise and submit to the Provincial People's Committee to issue regulations on land use rights auctions (if necessary); implement digital transformation in asset auctions (including land use rights auctions), ensure information on asset auctions is public, transparent, strict, scientific, and avoids exploitation during the process of participating in and conducting auctions.
The Department of Natural Resources and Environment shall preside over and coordinate with the Department of Justice, the Department of Finance, the Department of Construction, and the People's Committees of districts, towns, and cities to strictly implement the Prime Minister's Official Dispatch No. 134/CD-TTg dated December 14, 2024. It is necessary to further strengthen the inspection and examination of land use rights auction activities in cases showing signs of abnormality; promptly detect inadequacies in legal regulations to advise and propose competent authorities to amend and supplement them appropriately; at the same time, handle according to authority or propose competent authorities to strictly handle organizations and individuals who violate the provisions of the law on land use rights auctions, especially acts of taking advantage of land use rights auctions for profit, causing market disruption.
The Department of Construction shall preside over and coordinate with the Department of Natural Resources and Environment, the Department of Justice, the Department of Finance, and the People's Committees of districts, towns, and cities to urgently study and specifically assess the impact of the results of land use rights auctions in the recent past (especially cases with unusually high auction results, many times higher than the starting price) on the price level of residential land, housing, and the real estate market in the province.
