Termination of contract with contractor violating progress

The Traffic Department officially terminated the contract with the contractor Anh Vinh Group Joint Stock Company due to serious violations of the construction progress according to the contract.

On December 24, information from the Traffic Construction Investment Project Management Board (Traffic Board) said that the unit officially decided to terminate contract 378/2018/HDTC-KQLĐTND-AV dated March 16, 2018 with Anh Vinh Group Joint Stock Company.

Thanh Da peninsula landslide prevention project is sluggish after many years of construction.

This is a contract to implement the construction package of the above-ground part (embankment body and embankment top) of the Thanh Da Peninsula Erosion Prevention Project - Section 2 (Saigon River - Saigon Domaine Hotel Area) and related contract appendices.

The reason given by the Traffic Department is that Anh Vinh Group Joint Stock Company did not fulfill its obligations to extend the contract guarantee and advance payment guarantee; seriously violated the construction progress according to the contract as well as the commitments with the Traffic Department in meetings, seriously affecting the progress, quality and efficiency of the bid package; abandoned the project, exceeding the deadline by 56 consecutive days without performing the work according to the contract.

The Traffic Department assigns the Waterway Project Management Board to preside over and be responsible for drafting the report, submitting the contract termination to the competent authority and the termination procedures according to regulations.

At the same time, work with relevant units to determine the financial obligations and other obligations of contractor Anh Vinh when terminating the contract; determine the remaining workload, and organize implementation in accordance with current regulations.

The Thanh Da Peninsula landslide prevention project - section 2 has a total length of 2.797km with an investment capital of over 319 billion VND from the city budget. The above-ground construction package (embankment body and embankment crest) is implemented by the joint venture of Anh Vinh Group Joint Stock Company - Thanh Hung Company Limited - Vu Bach Trading and Construction Company Limited, starting construction in 2018.

Regarding the progress of implementation, Thanh Hung Company Limited and Vu Bach Trading and Construction Company Limited have completed 98% of the work volume according to the joint venture agreement. Anh Vinh Group Joint Stock Company has only completed 18% of the work volume and has stopped construction, failing to meet the progress.
