June 10: The National Assembly discussed the draft laws: Citizen identification (amended); Telecommunications (amended); Credit institutions (amended).

The National Assembly held a plenary session in the hall.

It is expected that in the morning , National Assembly deputies will discuss in groups: the draft Law on Citizen Identification (amended); the draft Law on Telecommunications (amended).

In the afternoon , the National Assembly discussed in the hall the draft Law on Credit Institutions (amended).

The afternoon session was broadcast live on Vietnam National Assembly Television.

Regarding the draft Law on Citizen Identification (amended) , on the afternoon of June 2, Minister of Public Security To Lam, authorized by the Prime Minister, presented a report on this draft law.

Accordingly, the development of the Law project is necessary to remove difficulties and obstacles in the implementation of the 2014 Law on Citizen Identification and meet current requirements and tasks, create a legal basis for implementation, and create a breakthrough in digital transformation in our country.

The development of the Law on Identification aims to: serve the settlement of administrative procedures and provide online public services; develop the economy and society; build digital citizens; perfect the ecosystem serving the connection, exploitation, supplementation and enrichment of population data; serve the direction and administration of leaders at all levels.

To fully and closely specify the above policies in the draft Law, ensuring comprehensiveness and conformity with the scope of regulation and subjects of application of the Law, the Government has revised the name of the draft Law from "Law on Citizen Identification (amended)" to "Law on Identification".

In terms of structure, the draft Law on Identification consists of 7 chapters and 46 articles, of which 39/39 articles are amended and 7 new articles are added compared to the 2014 Law on Citizen Identification.

Regarding the content shown on the ID card, the draft Law amends and supplements in the direction of removing fingerprints; amending regulations on information on ID card number, the words "citizen identification card", hometown, permanent residence, signature of the card issuer to personal identification number, the words "ID card", place of birth registration, place of residence...

The above changes and improvements are to create more convenience for people in the process of using ID cards, limit the need to issue new ID cards and ensure people's privacy;

Citizens' basic identification information will be stored, exploited, and used through the electronic chip on the identification card. For issued citizen identification cards, they are still valid and are not affected by this regulation.

Regarding people who are granted ID cards, the draft Law supplements regulations on the management and issuance of ID cards to people under 14 years old and the issuance of ID certificates to people of Vietnamese origin to ensure their legitimate rights and interests and serve state management; promote the value and utility of ID cards in the activities of digital government and digital society.

However, card issuance for people under 14 years old will be done according to demand, while for people 14 years old and above it is mandatory.

Currently, the Ministry of Public Security has issued nearly 80 million citizen identification cards to eligible people, so the regulation on the expiration date of the basic identity card does not affect the people;

This regulation will limit the continued use of old identity cards, which are not as secure as ID cards and do not have many utilities; encourage people to change their habits by using electronic chip ID cards.

Chairman of the National Assembly's Defense and Security Committee Le Tan Toi presented the Report on the review of the draft Law on Citizen Identification (amended).

The National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam. The Minister of Public Security explained and clarified a number of issues raised by National Assembly deputies.

Regarding the draft Law on Telecommunications (amended), reporting to the National Assembly, Minister of Information and Communications Nguyen Manh Hung affirmed the necessity of developing this draft law.

The Minister emphasized that the 2009 Telecommunications Law has important significance for the development and integration process of the economy in general and the telecommunications industry in particular, marking a new step of development of telecommunications law in our country, especially in the face of globalization.

In addition to the achieved results, the Telecommunications Law has revealed limitations and inadequacies, which are not suitable for the new context with many changes, requiring comprehensive amendments to build a legal corridor suitable for new requirements and overcome difficulties in implementation and state management in recent times.

The purpose of building the Law is to fully institutionalize and properly implement the Party's policy on developing a market economy with State regulation in telecommunications activities, developing telecommunications infrastructure and other infrastructures to create a foundation for the development of the digital economy and digital society.

Overcoming institutional problems, policy loopholes, and inadequacies in the provisions of the 2009 Telecommunications Law and other legal provisions related to telecommunications activities that limit the development process. Ensuring the consistency, synchronization, and feasibility of the Law with the legal system, in accordance with international commitments of which Vietnam is a member, and simplifying administrative procedures.

At the same time, supplement regulations on new contents, in line with the trend of telecommunications development, convergence trend, and formation of digital infrastructure - infrastructure of the digital economy.

The draft Law is currently composed of 10 chapters and 74 articles, regulating telecommunications activities, rights and obligations of organizations and individuals participating in telecommunications activities; and state management of telecommunications.

This Law applies to Vietnamese organizations and individuals and foreign organizations and individuals directly participating in or related to telecommunications activities in Vietnam.

Regarding the draft Law on Credit Institutions (amended), on the morning of June 5, authorized by the Prime Minister to present the Report, Governor of the State Bank of Vietnam Nguyen Thi Hong said that the drafting of the Law aims to perfect regulations and handle difficulties and inadequacies of the law on credit institutions; legalize to create a legal corridor for handling bad debts of credit institutions.

In addition, the development of the Law on Credit Institutions (amended) aims to strengthen risk prevention, enhance the capacity for self-inspection, internal control, and self-responsibility of credit institutions; develop tools to manage credit institutions; promptly detect violations and promptly handle the responsibilities of individuals managing and operating credit institutions; strengthen decentralization and delegation of authority associated with inspection, supervision, and individualization of individual responsibilities; and ensure publicity and transparency in banking activities.

The Law on Credit Institutions (amended) also aims to ensure the safety of the credit institution system; strengthen inspection and supervision measures of the State Bank, with the participation of the Government Inspectorate, the Ministry of Finance and ministries and branches to manage and control credit activities, combat manipulation, group interests, cross-ownership; handle situations where depositors withdraw money en masse and have an effective mechanism to restructure specially controlled credit institutions.

Regarding the viewpoint on law-making, the Governor of the State Bank of Vietnam said that the drafting of the Law on Credit Institutions (amended) needs to closely follow the viewpoints of the Party and the State in order to perfect the legal framework on currency, banking activities, and restructure credit institutions to ensure system safety, enhance transparency, publicity, and compliance with market principles and international best practices, facilitating the digital transformation process in the banking industry.

The drafting of the Law on Credit Institutions (amended) needs to overcome current difficulties and shortcomings; refer to international practices and experiences and be consistent with the development strategy of the banking sector.

The content of the draft law submitted to the National Assembly at the 5th Session retains 48 Articles, amends and supplements 144 Articles, adds 10 new Articles and basically covers the 2 contents requested by the National Assembly Standing Committee.

On the afternoon of June 5, National Assembly deputies also discussed in groups the draft Law on Credit Institutions (amended).
