To bring the laws into life soon
On the afternoon of June 21, continuing the 7th session, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law.
Discussing the draft Law, the majority of National Assembly deputies expressed their high approval for putting the draft Laws into effect early.
Speaking at the meeting, delegate Pham Van Hoa (Dong Thap delegation) supported the policy of bringing the above laws into practice soon. The delegate said that some provisions in the laws can be implemented immediately, however, there are still many contents that need detailed guidance documents.
Therefore, delegates suggested that the Government carefully prepare and ensure the progress and quality of detailed guidance documents, especially those developed by localities; organize propaganda and widely disseminate laws, create unity in awareness of law enforcement, and ensure effective implementation of these laws when they come into effect.
From a local perspective, National Assembly Deputy Nguyen Truc Anh (Hanoi delegation) said that speeding up the implementation of the Law 5 months earlier would resolve a series of existing limitations in the implementation of land-related issues. “The Government has made many innovations in law making and enforcement. Law projects that are implemented earlier will have a positive impact on the economy and society,” said Deputy Nguyen Truc Anh.

National Assembly Deputy Nguyen Quang Huan (Binh Duong delegation) said that real estate businesses are currently facing many difficulties. If the situation can be resolved, it will have a positive impact on the economy and GDP growth in the last 6 months of 2024.
Mr. Huan said that there are FDI enterprises that want to expand production but are currently having to stop because of the law. FDI enterprises have plans to allocate capital, if delayed, it could lead to restructuring or changing investment areas.
"Therefore, the sooner the law is enacted, the better," Mr. Huan commented.
However, Mr. Huan also cited the detailed audit report, including the issue of issuing Decrees, Circulars, and documents guiding the law. "In the group discussion, many localities also raised the difficulty of saying that if the Central Government has not yet provided guidance, where will the localities get the basis to implement it?", Mr. Huan said that this is an issue that needs attention.
From there, he suggested that the Government urgently issue Decrees to reassure localities, organize mass training to complete local guidelines. The Government should also anticipate emerging risks and ways to respond.
Mr. Huan said that it is impossible to say in general that the Government will take responsibility. There may be problems when implementing, so there must be a response to the risks. The National Assembly, the Government, and localities need to work together to resolve the issues to put these four laws into effect soon.
Unblock and attract resources
Giving his opinion, National Assembly Deputy Ha Sy Dong (Quang Tri delegation) shared that from his local management practice, he hopes these laws will soon come into effect.
According to the delegate, the current laws are overlapping, contradictory, and have too many shortcomings in understanding and implementation. Many officials violate the law and get caught up in legal trouble, partly due to those shortcomings. Many officials “avoid” and “pass the buck” for fear of responsibility, also due to those shortcomings.
He noted that the issues pointed out in the Economic Committee's review report on the bill also need to be fully considered, especially identifying and assessing the influence and impact on the business investment environment, the legitimate rights and interests of people and businesses, especially the reaction and psychology of society.

He said the Government affirmed that there is sufficient basis for detailed regulations and instructions on the implementation of the law to be issued to ensure progress and quality for implementation when it takes effect from August 1.
This is considered a fulcrum for delegates to vote to approve the early entry into force. “What I am concerned about is that the progress of issuing those documents depends a lot on the preparation of ministries and branches,” he shared.
Mr. Dong said that the Government’s proposal and responsibility are correct, but each National Assembly member who has “pressed the button” must also be responsible for his or her decision. The delegate suggested that before passing the Law, the drafting agency should send to the National Assembly any issues that may arise when the above laws take effect early, if any, how to resolve them, and which agency is responsible for resolving them.
Explaining the issues raised by the National Assembly deputies, Minister of Natural Resources and Environment Dang Quoc Khanh acknowledged the enthusiastic and responsible opinions of the National Assembly deputies. The majority of the National Assembly deputies highly agreed with the Government's dossier and hoped that, along with the voice of the voters, the Law would take effect soon.

Mr. Khanh said that to effectively implement the Land Law and the Real Estate Business Law, regulations, guiding documents, decrees, decisions, circulars and guiding documents of localities have been carefully prepared.
The Minister said that since the National Assembly agreed to amend the Land Law, the drafting agency and relevant agencies have implemented the decrees and circulars according to regulations.
Therefore, Mr. Khanh believes that the procedures are fully implemented, there is no shortening of the process, no hasty law making.
“The so-called shortening here is shortening the validity period and implementation time,” said Mr. Khanh.
Mr. Khanh affirmed that the Government and the National Assembly agreed to soon implement these three laws, following all the procedures, early but complete, ensuring the quality of the laws.
Regarding the effects of the Laws coming into life, Mr. Khanh said that many policies of the three laws will unlock the country's resources, attract resources and effectively use natural resources and land. Thereby, many backlogs and expectations of people and businesses will be resolved.
For example, the 2024 Land Law stipulates that households with stable land production and business, no disputes, no violations of the law from July 1, 2014 or earlier, but do not have a land ownership certificate, will be granted a land ownership certificate...
According to Mr. Khanh, the early implementation of the Land Law will create conditions for overseas Vietnamese to participate in the land market like Vietnamese people in the country, giving them the opportunity to participate in the market and unlocking resources .
