The report of the Ministry of Culture, Sports and Tourism said that currently, some regulations in Decree No. 54 have arisen and caused difficulties for organizations and businesses operating karaoke and dance clubs.
Accordingly, some regulations on business conditions are no longer suitable to reality; the content has not been specified, and the provisions of the law on fire prevention, fighting, rescue, and related technical standards and regulations have not been referenced in a unified and systematic manner.
The draft Decree has updated and revised regulations on business conditions for fire prevention and fighting and security and order; supplemented the responsibilities of enterprises and business households in ensuring compliance with technical standards and regulations on fire prevention and fighting.
In addition, the draft Decree stipulates that the Provincial People's Committee is the agency that issues, adjusts, and revokes licenses; clearly assigns the responsibilities of departments, branches, district-level People's Committees, and commune-level People's Committees in the work of issuing, inspecting, and revoking business licenses.
The Deputy Prime Minister emphasized that karaoke and discotheque services are sensitive and need to be strictly managed because they are places where many people gather, mostly young people, who use drinks, and have the potential to use drugs, addictive substances, social evils, environmental pollution, noise, etc., as well as cultural content, traditions and customs.
"In the long term, licensing of karaoke and discotheque businesses must follow planning, ensure safety, security and order; prevent and combat fires and explosions, environmental pollution, noise; not affect the lives and activities of people in residential areas, the activities of administrative agencies, educational institutions, health care, religions, beliefs, historical and cultural relics...", the Deputy Prime Minister emphasized and noted that licensed karaoke and discotheque businesses must thoroughly overcome and fully comply with fire and explosion prevention and fighting standards and techniques.
Leaders of the Ministry of Public Security, Ministry of Planning and Investment, Ministry of Construction, Ministry of Justice, etc. agreed with the regulations on decentralization and delegation of power to localities, clearly defining the responsibilities of specialized state management agencies for karaoke and discotheque business activities.
At the same time, opinions analyzed and clarified the conditions for granting business licenses for karaoke and discotheque services related to fire and explosion prevention and safety, ensuring security and order; time for assessing licensing conditions; dossiers and procedures for building new, renovating and repairing karaoke and discotheque service establishments; adding types of food and beverage service establishments accompanied by singing or performing arts activities; specifying cases of revoking business licenses for establishments violating fire and explosion prevention and safety; assessing the impact of regulations on minimum area of karaoke rooms and discotheques, etc.
Concluding the meeting, Deputy Prime Minister Tran Hong Ha requested the Ministry of Culture, Sports and Tourism to absorb and complete regulations on decentralization of authority to localities, along with clearly defining the responsibilities of specialized state management agencies; the appraisal of records and fire prevention and fighting designs should be decentralized to the district level, implemented in the direction of pre-inspection; regulations on records, procedures, and criteria for cases of temporary suspension and revocation of business licenses; cases; research appropriate management methods for the type of food service business combined with singing and performing arts activities...
