This request was made by the Ministry of Health in response to the situation of commercial trafficking of sperm, eggs, embryos, and surrogacy in some localities.
The Ministry of Health requests the Health Departments of provinces and centrally run cities and related units to comply with legal regulations on reproductive support to prevent commercial surrogacy, gamete trafficking occurring in medical facilities or acts of assisting or participating in illegal networks.
The official dispatch of the Department of Maternal and Child Health stated that facilities need to review and develop additional procedures to prevent confusion, for all cases requiring patient identification to control confusion or exchange of patients, sperm, eggs, and embryos. In particular, special attention should be paid to the following procedures: semen sampling; egg retrieval; embryo transfer; transportation and receipt of sperm/eggs/embryos between hospitals; and cases of surrogacy for humanitarian purposes.
Encourage hospitals to manage cases of sperm/egg/embryo donation/reception, in vitro fertilization, and surrogacy for humanitarian purposes on software that uses modern biometric identification techniques such as facial photography, fingerprints, and iris scanning to prevent confusion or patient swapping due to the use of fake documents.
In particular, carefully review the legality of surrogacy records for humanitarian purposes. For cases of surrogacy for humanitarian purposes and pre-implantation genetic testing, they should be approved by the Professional Council and signed by the Hospital Director to prevent surrogacy for commercial purposes and fetal sex selection.
Facilities need to complete procedures and strengthen internal inspection and supervision activities, ensuring that officers and employees do not participate in, get involved in, or assist in sperm/egg/embryo trafficking, surrogacy, or gender selection of fetuses; and strictly handle employees who violate regulations.
It is necessary to closely coordinate with the authorities to detect, prevent and legally handle cases of surrogacy and fetal sex selection occurring in medical facilities.
In case of detecting violations by staff, hospitals must immediately report to the Ministry of Health (Department of Maternal and Child Health, Department of Legal Affairs) for settlement according to authority.
