Vehicles must have headlights.
According to point d, clause 1 and clause 2 of the 2008 Road Traffic Law, both motorbikes and cars must have sufficient near and far lights.
In which, headlights are high-beam lights with strong light intensity, longer beam distance and higher visibility, helping drivers see obstacles and signs from a distance.
Use lights legally
Prohibition of headlights in residential areas
Clause 12, Article 8 of the 2008 Road Traffic Law stipulates as follows:
“Article 8. Prohibited acts
12. Honking and revving the engine continuously; Honking from 10pm to 5am the following day, honking the horn, using high beams in urban areas and densely populated areas, except for priority vehicles on duty as prescribed by this law.
Thus, high beams should not be used in urban and densely populated areas.
In which, urban roads are roads within the administrative boundaries of inner cities, inner towns and townships. Roads through densely populated areas are road sections located within inner-city, inner-town, inner-town areas and road sections with residents living close along the road, with activities that may affect road traffic safety and are identified by signs as roads through densely populated areas (when necessary, they can be identified separately for each direction of the road).
At the beginning of a densely populated area, sign R.420 will appear and at the end of a densely populated area, sign R.421 will appear. (Standard 41/2019/BGTVT national technical regulation on road signs).

Do not turn on the headlights when avoiding oncoming vehicles.
Article 17 of the 2008 Road Traffic Law stipulates on avoiding oncoming vehicles as follows:
“Article 17. Avoid vehicles going in the opposite direction.
1. On a road that is not divided into two separate directions, when two vehicles traveling in opposite directions avoid each other, the driver must reduce speed and move the vehicle to the right in the direction of travel.
2. Cases of giving way when avoiding each other are regulated as follows:
a) On narrow roads where there is only enough room for one vehicle and there is a place to avoid the other vehicle, the vehicle closer to the place to avoid must move into the avoiding position and give way to the other vehicle.
b) Vehicles going downhill must give way to vehicles going uphill.
c) Any vehicle with an obstacle in front must give way to the vehicle without an obstacle.
3. Motor vehicles traveling in opposite directions must not use high beams when meeting each other.
So, when avoiding oncoming vehicles, do not turn on the headlights.
Penalty for using headlights incorrectly
Point b, g, Clause 3, Article 5; Point m, n, Clause 1, Article 6, Point d, e, Clause 3, Article 7, Decree 100/2019/ND-CP), if turning on high beams in urban areas, densely populated areas, when avoiding oncoming vehicles, the vehicle driver will be fined at the following levels:
- For cars and similar vehicles: Fine from 800,000 VND to 1,000,000 VND.
- For motorbikes (motorbikes), motorbikes (including electric motorbikes), motorbike-like vehicles and motorbike-like vehicles: Fine from 100,000 VND to 200,000 VND.
- For tractors and specialized motorbikes: Fine from 400,000 VND to 600,000 VND.
