Dozens of special mechanisms and policies
On the morning of May 31, continuing the 7th Session, the National Assembly listened to the Presentation and Verification Report on the Draft Resolution on organizing urban government and piloting a number of specific mechanisms and policies for the development of Da Nang city.
Presenting a report to the National Assembly, Minister of Planning and Investment Nguyen Chi Dung said that Resolution No. 43-NQ/TW dated January 24, 2019 of the Politburo agreed on the need for specific mechanisms and policies to build and develop Da Nang city, creating momentum for the development of the Central Highlands - Central region and the whole country.

The Politburo has assigned the organization to officially apply the urban government model; supplement and perfect specific mechanisms and policies for city development, especially in investment management; finance, budget, tax; planning; science and technology; innovation; semiconductor chips, artificial intelligence; attracting strategic investors in airports, seaports... for the pilot construction of free trade zones; regional-scale international financial centers;
Develop Da Nang into a center for innovation and startups, a high-tech center of the country; a regional center for logistics, tourism - services, training of high-quality human resources in the fields of semiconductors, artificial intelligence... perfecting the state management system on food safety towards a unified management point.
According to Minister Nguyen Chi Dung, after 3 years of piloting the organization of urban government, many positive results have been achieved. In the context of current development and through assessment, Da Nang city has enough conditions and basis to officially implement the organization of urban government and needs to have special mechanisms and policies that are outstanding, breakthrough, motivating and pervasive.
The Draft Resolution includes 9 policies on the organization of urban government in Da Nang city, including 7 similar policies that have been applied in many other localities across the country and 2 new proposed policies: Regulations on the authority of relevant agencies to perform tasks and powers performed by the District People's Council and Ward People's Council according to the provisions of law (point k, clause 3, Article 7 and point g, clause 3, Article 8 of the draft Resolution);
Regulations on the authority of the City People's Council to abolish documents issued by the District and Ward People's Councils before July 1, 2021 (Clause 1, Article 19 of the draft Resolution).
The Draft Resolution also proposes to pilot 21 specific policies for the development of Da Nang City. Of these, there are 6 policies that are completely similar to those of the provinces and cities that have been allowed by the National Assembly to implement in specific Resolutions, 10 similar policies with adjustments and supplements to suit the reality of the City, and 5 new proposed policies, including:
Policy 1 : Pilot establishment of Da Nang Free Trade Zone (Article 13 of draft Resolution).
Based on the study of some successful free trade zone models in the world such as EU, China, Singapore, Korea... selectively approaching the successful incentive policies from economic models that have been implemented in the country, the draft Resolution proposes a development plan for the Da Nang Free Trade Zone to be built with 3 functional areas: production; port logistics - logistics; trade - services.
The development of the Da Nang free trade zone aims to create new development momentum, help accelerate the city's socio-economic development, promote its role as a locomotive, leading the economic development of the North Central and Central Coast regions; is the basis for piloting new policy research, and is a premise for legalizing regulations on free trade zones for the whole country.
Policy 2 : The city is allowed to recover land for socio-economic development for national and public interests for the logistics center project (Clause 4, Article 11 of the draft Resolution).
Policy 3 : Developing the field of semiconductor microchips and artificial intelligence (Clause 4, Article 14 of the draft Resolution).
Policy 4 : Investment, management, exploitation and handling of infrastructure assets and equipment serving science and technology development and innovation (Clause 3, Article 14 of the draft Resolution).
Policy 5 : Public service organizations assigned to manage and operate technical infrastructure of industrial clusters that have been invested from public investment capital sources shall be allocated land by the State, leased land, and subleased land. (Clause 3, Article 9 of the draft Resolution).
The Draft Resolution takes effect from January 1, 2025.
Breakthrough policy, dare to think, dare to do
Presenting the Report on the review of the draft Resolution of the National Assembly on the organization of urban government and piloting a number of mechanisms and policies for the development of Da Nang City, Chairman of the National Assembly's Finance and Budget Committee Le Quang Manh said that the pilot establishment of the Da Nang Free Trade Zone, the current law does not have regulations on the concept of free trade zones, on the guidance on the establishment and operation of free trade zones, but only stipulates that the duty-free zone is determined in the general planning for the construction of the economic zone.

However, Decision No. 1287 dated November 2, 2023 of the Prime Minister on approving the Da Nang City Planning for the period 2021 - 2030, with a vision to 2050; in which, the key tasks mentioned: " Focus on developing Da Nang into a regional-scale international financial center, forming a duty-free zone, a free trade zone, developing information technology and communications services, healthcare, high-quality education and training ".
In terms of practical basis, the Chairman of the National Assembly's Finance and Budget Committee said that the establishment of Free Trade Zones is a new model in Vietnam; currently there are only models of Industrial Parks and Economic Zones. However, this is a model that has been successfully applied in many countries around the world.
The majority of opinions of the Finance and Budget Committee agreed that the pilot establishment of a Free Trade Zone is a breakthrough policy, daring to think and dare to do by Da Nang City and the Government in applying the world's advanced development model. If successfully implemented, it will create a premise to promote the socio-economic development of Da Nang City and the whole Region. The pilot is meant to lay the foundation for the formation of new policies in the process of operating a socialist-oriented market economy. At the same time, it is a testing step, while doing it, we will gain experience to gradually improve.
Some opinions say that policies for free trade zones are not yet regulated in the legal system, are not specific, have not determined competitive advantages, have not assessed the impact on security and defense, and do not have outstanding, breakthrough policies; many tax policies are similar to those applied to economic zones.
Therefore, it is proposed to clarify the concept of free trade zones, similarities and differences compared to economic zones and duty-free zones; supplement international experience in forming and developing this model to clarify the convincing basis, and at the same time assign the Government to study and propose a report to the National Assembly Standing Committee to decide on the model when implementing.
It is proposed that, in order to ensure the development of policies on free trade zones, creating breakthroughs and excellence, it is necessary to develop a separate Project on free trade zones and submit it to the National Assembly for consideration and decision .
