Proposing a special mechanism for land allocation and lease to attract educational investors

The Ministry of Planning and Investment has responded to the petition sent by Thanh Hoa province voters to the 8th session of the 15th National Assembly regarding a special mechanism to attract investors for education.

Research has a special mechanism to attract investors to develop education.

Voters of Thanh Hoa province cited Decree 25/2020 of the Government promulgating detailed regulations for the implementation of a number of articles of the Law on Bidding on investor selection.

Voters proposed to study and have a specific mechanism for land allocation and leasing in the field of socialized education to call for and attract investors for educational development, mobilize socialized resources to effectively implement Resolution 35/2019 of the Government.

Responding to this content, the Ministry of Planning and Investment clearly stated that there are currently difficulties in bidding to select investors, including determining which business investment projects must be organized for bidding; bidding processes and procedures, methods and standards for evaluating business investment projects.

These contents are stipulated in the Law on Bidding, Decree 23/202 of the Government detailing a number of articles and measures to implement the Law on Bidding on selecting investors to implement projects in cases where bidding must be organized according to the provisions of the law on industry and sector management.

Along with that is Decree 115/2024 of the Government detailing a number of articles and measures to implement the Law on Bidding on selecting investors to implement investment projects using land and the circular guiding the implementation of this Decree.

Proposal to amend regulations related to procedures for establishing industrial clusters

Thanh Hoa voters also requested the Ministry of Planning and Investment to propose to the Prime Minister to soon unify and amend regulations related to procedures for establishing industrial clusters in accordance with the Prime Minister's direction.

This timely responds to attracting investment projects to build and operate technical infrastructure of industrial clusters in the province.

At the same time, to enable local sectors and units to properly implement the procedures related to approving investment policies and establishing industrial clusters in the coming time, without creating administrative procedures and shortening implementation time.

Responding to this content, the Ministry of Planning and Investment cited the 2014 Investment Law, which stipulates that the Provincial People's Committee decides on investment policies for projects that are allocated land by the State, leased land without auction, bidding or transfer; projects that require change of land use purpose.

The 2020 Investment Law stipulates that the Provincial People's Committee decides on the investment policy of investment projects that request the State to allocate land, lease land without auction, bidding or transfer, and investment projects that request permission to change land use purposes.

Except for cases of land allocation, land lease, and permission to change land use purposes of households and individuals that are not subject to written approval from the Provincial People's Committee according to regulations of the law on land.

Approval of investment policy and establishment of industrial clusters are two different processes and procedures.

Procedures for approving investment policies are implemented according to the provisions of the Investment Law 2014 and the Investment Law 2020.

Along with that, the procedures for deciding to establish and expand industrial clusters are implemented according to Decree 68/2017, Decree 66/2020 and Decree No. 32/2024 of the Government on management and development of industrial clusters.

Therefore, the Ministry clearly stated that in principle, investment projects to build technical infrastructure for industrial clusters must carry out both investment policy approval procedures and procedures to establish and expand industrial clusters according to the above regulations.
