In particular, the General Secretary pointed out that the quality of law making and improvement has not met practical requirements, and some newly issued laws have had to be amended. In addition, regulations are not really consistent, there are overlaps, many regulations are difficult, hindering implementation, causing loss and waste of resources.

From the above practice, the General Secretary emphasized the need to strongly innovate legislative work and resolutely abandon the mindset of "if you can't manage it, ban it". Legal provisions must be stable and long-term, the law only regulates framework issues, and does not need to be too long. Practical issues that fluctuate frequently should be assigned to the Government and localities to regulate to ensure flexibility in management. At the same time, it is necessary to promote decentralization and delegation of power with the motto "locality decides, locality does, locality is responsible".

When working with the Party Committee of the Ministry of Justice, General Secretary To Lam stated that the work of law-making has a special role, position, and importance, and is of key significance in seizing opportunities, opening up, and strongly mobilizing resources for development and caring for the people.

According to the General Secretary, it is no coincidence that since the 12th National Congress, our Party has always identified institutional breakthroughs, focusing on legal breakthroughs as strategic breakthroughs. In order for the country to firmly enter the new era and soon successfully complete the strategic goals set by the Party, the urgent reality is requiring the work of building laws at a new level, truly creating a strong driving force for development.

From there, the General Secretary requested that the development of laws and ordinances must be truly lively, fully, correctly and promptly institutionalizing the Party's policies, reflecting the breath of reality, closely following reality, solving practical problems; removing legal "bottlenecks", urgently putting stagnant and wasteful social resources back into operation.

In order for the institution to truly breathe life, in his speeches, National Assembly Chairman Tran Thanh Man always emphasized that the law-making process must be based on the concretization of the Party's policies and resolutions, and at the same time, it must originate from reality, taking people and businesses as the center.

“The laws and resolutions passed by the National Assembly must be of high quality and long-lasting, creating favorable conditions and giving the Government proactive and flexible authority in the process of organizing the implementation of the law,” the National Assembly Chairman expressed.

In an article reviewing the recent 8th session, National Assembly Chairman Tran Thanh Man affirmed that this was a historic session with many tasks and projects of strategic significance in the new development era that were discussed and decided. With a spirit of innovation, new momentum, new determination, and the Government's efforts, the National Assembly has resolved many difficult and complicated issues, many long-standing issues related to many sectors, fields and practices that are urgently needed. With a "record" number of legislative activities, the National Assembly voted to pass 18 laws and 21 resolutions, which have received great attention and follow-up from voters, people and the business community.

In particular, there are draft laws and resolutions considered and approved by the National Assembly under simplified procedures, which are breakthrough policies, aiming to promptly remove difficulties for investment, production and business activities, speed up the progress of public investment projects, and promote growth.

In addition, the National Assembly's historic decisions also have a long-term vision, creating a legal basis for new issues and new trends, such as data management and use, digital technology industry development, investment policy for high-speed railway projects on the North-South axis, nuclear power development and offshore wind power... These decisions will contribute significantly to the successful implementation of the digital transformation revolution, keeping up with the trend of the times, promoting strong socio-economic development in the new era.

“The legislative work has closely followed and realized the spirit of strongly transforming the thinking of law-making in the direction of both ensuring the requirements of state management and encouraging creativity, liberating all productive forces, and opening up all resources for development. The management thinking is not rigid, and has definitely abandoned the thinking of “if you can’t manage, then ban”, Mr. Tran Thanh Man stated.

Speaking with Tien Phong , National Assembly delegate Tran Thi Nhi Ha - Deputy Head of the People's Aspirations Committee, under the National Assembly Standing Committee, highly appreciated the National Assembly's use of the legislative technique of "one law amending many laws".

However, the National Assembly is also very cautious when using this legislative technique. Regarding the removal of infrastructure bottlenecks, the female delegate from Hanoi acknowledged that the approval of the North-South high-speed railway project is a “dream” that has been realized after nearly 20 years of incubation. “This is also a project supported by the people of the whole country, intellectuals, and businesses. With a large capital scale and profound socio-economic impacts, this is certainly one of the iconic projects in the new era,” said Ms. Ha.

Similarly, with the Ninh Thuan Nuclear Power Project, according to the delegate, this is also a major, strategic decision. “The Ninh Thuan Nuclear Power Plant has been suspended since 2016, the National Assembly's decision to restart the project shows that Vietnam is ready for innovation in the era of national development,” said Ms. Ha.

Regarding the contents to be discussed at the extraordinary session, the National Assembly Standing Committee has agreed to submit to the National Assembly for consideration and decision on 7 important contents. In particular, the National Assembly will consider and decide on draft laws affected by the consolidation and streamlining of the apparatus, namely: Law on Organization of the National Assembly, Law on Organization of the Government and Law on Organization of Local Government, amended.

When giving his opinion on this issue, National Assembly Chairman Tran Thanh Man emphasized the view that the revised bills must ensure consistency and synchronization with related laws and definitely not stipulate content under the authority of the Government, the Prime Minister and ministries. Therefore, it is necessary to review, research and assess the impact carefully, not to skip the steps in the law-making process because of urgency. When promulgated, the law must be concise, focused, focusing on amending only the truly necessary and urgent issues.

“To enact a law is to be responsible to the nation and compatriots. When a law is enacted, it must have a lifespan. Of course, when a law is enacted and is unreasonable, we must amend it, but we must minimize this problem,” the National Assembly Chairman noted.

Along with the urgent need to amend a number of draft laws related to streamlining the apparatus, at the Resolution of the specialized meeting on law-making in January 2025, the Government agreed on the necessity of developing and promulgating Resolutions on the establishment of a number of ministries on the basis of reorganizing a number of ministries of the Government of the 15th National Assembly term and the structure of Government members of the 15th National Assembly term.

At the same time, to ensure the smooth operation of the apparatus, the head of the Government always emphasizes the requirement that ministries and branches, according to their functions and tasks, continue to proactively review, research, amend and supplement legal documents affected by the reorganization of the apparatus. On that basis, it is necessary to quickly develop, promulgate and submit for promulgation documents serving the reorganization of the apparatus to ensure streamlining, strength, efficiency, effectiveness and efficiency; leaving no legal gaps and no interruptions in operations.
